5、apterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeLawofthePeople,sRepublicofChinaonMaternalandInfantHealthCare(hereinafterreferredtoasthe“LawonMaternalandInfantHealthCaren).第二条在中华人民共和 国境内从事母婴保健服务活动 的机构及其人员应当遵守母婴 保健法和本办法。第三条母婴保健技术服 务主要包括下列事项：（一）有关母婴保健的科普宣 传、教育和咨询；Article2Inst

6、itutionsprovidingmaternalandinfanthealthcareservicesintheterritoryofthePeoplesRepublicofChinaandtheirstaffmembersshallcomplywiththeLawonMaternalandInfantHealthCareandtheseMeasures.Article3Thetechnicalservicesformaternalandinfanthealthcaremainlyincludethefollowing:(1)popularsciencedissemination,educa

7、tionandconsultationofmaternalandinfanthealthcare;(2)pre-maritalmedicalexamination;（二）婚前医学检查；(3)prenataldiagnosisandgeneticdiseasediagnosis;（三）产前诊断和遗传病诊断；(4)skillsofmidwifery;（四）助产技术；(5)performanceofbirthcontrolsurgeryaccordingtomedicalneeds;（五）实施医学上需要的节育手术；(6)diseasescreeningfornewbornbabies;and（六）新

8、生儿疾病筛查；(7)otherreproductivehealthcareserviceson（七）有关生育、节育、不育childbearing,birthcontrolandinfertility.的其他生殖保健服务。第四条公民享有母婴保 健的知情选择权。国家保障公 民获得适宜的母婴保健服务的 权利。第五条母婴保健工作以Article4Citizensshallhavetherighttolearnthetruthofandtochoosematernalandinfanthealthcare.Thestateshallguaranteecitizens*righttoreceiveappr

9、opriatematernalandinfanthealthcareservices.Article5Thematernalandinfanthealthcareshallfocusonhealthcareforthepurposeofsafeguardingreproductivehealth,andimplementthepolicyofcombininghealthcarewithclinictreatments,meetingtheneedsofvariousgroupsandtheneedsofcitizensatthegrass-rootslevel,andgivingpriori

10、tytoprevention.Article6Thepeoplesgovernmentsatalllevelsshallincludematernalandinfanthealthcareintheirplansforeconomicandsocialdevelopment,providenecessaryeconomic,technicalandmaterialconditionsforthedevelopmentofmaternalandinfanthealthcare,andgivespecialsupporttothematernalandinfanthealthcareinareas

11、inhabitedbyethnicminoritiesandinpoverty-strickenareas.Thepeoplesgovernmentsatorabovethecountylevelmay,inlightoftheparticularconditionsandneedsoftheirrespectivelocalities,setupspecialfundforthedevelopmentofmaternalandinfanthealthcareundertaking.Article7ThehealthadministrativedepartmentundertheStateCo

12、uncilshallberesponsiblefortheworkofmaternalandinfanthealthcarethroughoutthecountry,andperformthefollowingduties:(1) DevelopingsupportingrulesandtechnicalnormsfortheLawonMaternalandInfantHealthCareandtheseMeasures.保健为中心，以保障生殖健康 为目的，实行保健和临床相结 合，面向群体、面向基层和预 防为主的方针Q第六条各级人民政府应 当将母婴保健工作纳入本级国 民经济和社会发展计划，为母

13、 婴保健事业的发展提供必要的 经济、技术和物质条件，并对 少数民族地区、贫困地区的母 婴保健事业给予特殊支持。县级以上地方人民政府根据本 地区的实际情况和需要，可以 设立母婴保健事业发展专项资 金O第七条国务院卫生行政 部门主管全国母婴保健工作， 履行下列职责：（一）制定母婴保健法及本办 法的配套规章和技术规范；（二）按照分级分类指导的原 则，制定全国母婴保健工作发 展规划和实施步骤；(2) Developingnationaldevelopmentplanandimplementationproceduresforthematernalandinfanthealthcareunderthep

14、rincipleofhierarchicalandclassifiedguidance.(3)Organizingthepopularizationofappropriatetechnologiesformaternalandinfanthealthcareandotherreproductivehealthservices.（三）组织推广母婴保健及其他生殖健康的适宜技术；(4)Exercisingsupervisionovertheworkofmaternalandinfanthealthcare.（四）对母婴保健工作实施监督。Article8Thedepartmentsofpublicfi

15、nance,publicsecurity,civilaffairs,education,humanresourcesandsocialsecurityofthepeople,sgovernmentsatorabovecountylevelshall,withinthescopeoftheirrespectivefunctions,coordinateeffortswiththehealthadministrativedepartmentatthesamelevelsintheworkofmaternalandinfanthealthcare.第八条县级以上各级人民政府财政、公安、民政、教育、人

16、力资源社会保障等部门应当在各自职责范围内，配合同级卫生行政部门做好母婴保健工作。ChapterIlPre-maritalHealthCare第二章婚前保健Article9ForthepurposesofArticle7oftheLawonMaternalandInfantHealthCare,thepremaritalhealthinstructionsincludethefollowing:第九条母婴保健法第七条所称婚前卫生指导，包括下列事项：(1)healthcareandeducationonsexualhygiene;（一）有关性卫生的保健和教育；(2)contraceptionand

17、familyplanninginstructionsfornewly-marriedcouples;（二）新婚避孕知识及计划生育指导；(3)pre-conceptionhealthcareknowledgesuchaspreparationforpregnancyandtheinfluenceofenvironmentanddiseasesonoffspring;（三）受孕前的准备、环境和疾病对后代影响等孕前保健知识；(4)basicknowledgeongeneticdiseases;（四）遗传病的基本知识;(5)basicknowledgeondiseasesaffectingthe（五）

18、影响婚育的有关疾病的基本知识;marriageandchildbearing;and（六）其他生殖健康知识。(6)otherknowledgeonreproductivehealth.医师进行婚前卫生咨询时，应 当为服务对象提供科学的信 息，对可能产生的后果进行指 导，并提出适当的建议。Doctorsshall,whenconductingpre-maritalhealthconsultations,providescientificinformationtotheirclients,giveinstructionsonpossibleconsequencesandofferappropria

19、teadvice.第十条 在实行婚前医学 检查的地区，准备结婚的男女 双方在办理结婚登记前，应当 到医疗、保健机构进行婚前医 学检查。Article 10 Intheregionsoperatingasystemofpre-maritalmedicalexamination,boththemaleandthefemaleplanningtogetmarriedshall,beforemarriageregistration,undergopre-maritalmedicalexaminationinmedicalandhealthcareinstitutions.第十一条从事婚前医学 检查的医

20、疗、保健机构，由其 所在地县级人民政府卫生行政 部门进行审查；符合条件的， 在其医疗机构执业许可证 上注明。Article 11 Themedicalandhealthcareinstitutionsconductingpre-maritalmedicalexaminationsaresubjecttotheexaminationofthehealthadministrativedepartmentofthepeoplesgovernmentsatthecountylevelwheresuchinstitutionsarelocated;andthosemedicalandhealthcare

21、institutionsmeetingtheconditionsshallbegivenaclearindicationonthePracticingLicenseforaMedicalInstitution.第十二条申请从事婚前 医学检查的医疗、保健机构应 当具备下列条件：Article 12 Toapplyforengaginginthepre-maritalmedicalexamination,amedicalandhealthcareinstitutionshallsatisfythefollowingrequirements:（一）分别设置专用的男、女 婚前医学检查室，配备常规检 查

22、和专科检查设备；(1) Havingseparateexaminationroomsformaleandfemale,andequipmentforroutineandspecialexaminations.（二）设置婚前生殖健康宣传 教育室；(2) Havingaroomforpre-maritalreproductivehealthpublicityandeducation.(3) Being staffed with licensed doctors qualified for pre-marital medical examination for male and female.（三）

23、具有符合条件的进行 男、女婚前医学检查的执业医 师。Article 13 A pre-marital medical examination shall include inquiry on medical history, physical examination and other relevant examinations.第十三条婚前医学检查 包括询问病史、体格及相关检 查。The pre-marital medical examination shall conform to the work norms for pre-marital health care, and be con

24、ducted in accordance with the items of premarital medical examination. The work norms of pre-marital health care and the items of pre-marital medical examination shall be provided for by the health administrative department under the State Council.婚前医学检查应当遵守婚前保 健工作规范并按照婚前医学检 查项目进行。婚前保健工作规 范和婚前医学检查项目

25、由国务 院卫生行政部门规定。Article 14 After a pre-marital medical examination, the medical and health care institution shall issue a pre-marital medical examination certificate to a person who has undergone such examination.第十四条 经婚前医学检 查，医疗、保健机构应当向接 受婚前医学检查的当事人出具 婚前医学检查证明。The pre-marital medical examination cert

26、ificate shall state whether the following diseases are detected:婚前医学检查证明应当列明是 否发现下列疾病：(1) Designated infectious diseases in the infectious period.（一）在传染期内的指定传染 病；(2) Relevant mental diseases in the morbid period.（二）在发病期内的有关精神 病；（三）不宜生育的严重遗传性 疾病；(3) Seriousgeneticdiseasesinappropriateforchildbearing.

27、（四）医学上认为不宜结婚的 其他疾病。(4) Otherdiseasesthataremedicallyconsideredinappropriateformarriage.发现前款第（一）项、第 （二）项、第（三）项疾病 的，医师应当向当事人说明情 况，提出预防、治疗以及采取 相应医学措施的建议。当事人 依据医生的医学意见，可以暂 缓结婚，也可以自愿采用长效 避孕措施或者结扎手术；医 疗、保健机构应当为其治疗提 供医学咨询和医疗服务。Doctorsshall,upondetectionofthediseasesspecifiedinitem(1),(2)or(3)ofthepreceding

28、paragraph,explainthesituationtotheparties,giveadviceonthepreventionandtreatmentofsuchdiseases,andproposecorrespondingmedicalmeasures.Partiesmay,inaccordancewiththemedicaladviceofdoctors,postponethemarriageorvoluntarilytakelong-actingcontraceptivemeasuresorundergoligationoperations;themedicalandhealt

29、hcareinstitutionshallprovidemedicalconsultationsandservicesforthetreatment.第十五条 经婚前医学检 查，医疗、保健机构不能确诊 的，应当转到设区的市级以上 人民政府卫生行政部门指定的 医疗、保健机构确诊。第十六条在实行婚前医 学检查的地区，婚姻登记机关 在办理结婚登记时，应当查验 婚前医学检查证明或者母婴保 健法第十一条规定的医学鉴定 证明。Article15Whereamedicalandhealthcareinstitution,afterpre-maritalmedicalexamination,failstoma

30、keadefinitediagnosis,thecaseshallbetransferredtoamedicalandhealthcareinstitutiondesignatedbythehealthadministrativedepartmentunderthepeoplesgovernmentatorabovethelevelofdistrictedcityforadefinitediagnosis.Article16Inregionsoperatingasystemofpremaritalmedicalexamination,themarriageregistrationorgansh

31、all,whenhandlingmarriageregistration,examinethepre-maritalmedicalexaminationcertificateorthecertificateofmedicalidentificationprescribedinArticle11oftheLawonMaternalandInfantHealthCare.第三章孕产期保健ChapterIIIHealthCareduringthePregnancyandPerinatalPeriod第十七条医疗、保健机 构应当为育龄妇女提供有关避 孕、节育、生育、不育和生殖Article17Medi

32、calandhealthcareinstitutionsshallprovideconsultationandmedicalhealthcareservicesoncontraception,birthcontrol,childbearing,infertility,andreproductivehealthforwomenofchildbearingage.健康的咨询和医疗保健服务。Whereadoctordetectsorsuspectsthatamarriedcoupleofchildbearingagesufferfromanyseriousgeneticdisease,thedoct

33、orshallgivethemamedicaladvice;whereadoctorfailstomakeadefinitediagnosisduetolimitedmedicaltechnology,thedoctorshallexplainthesituationtotheparties.Marriedcouplesofchildbearingagemaychoosecorrespondingmedicalmeasuresforcontraception,birthcontrolorwillingnonpregnancy.Article18Medicalandhealthcareinsti

34、tutionsshallprovidethefollowingmedicalhealthcareservicesforpregnantandlying-inwomen:(1) Makinghealth-carebooklet(card)andconductingregularprenatalphysicalexaminationforpregnantandlying-inwomen.(2) Providingmedicalinstructionsandconsultationonhygiene,nutritionandpsychologyforpregnantandlying-inwomen.

35、(3) Performingintensivemanagement,follow-upvisitsandmedicalhealth-careservicesforhigh-riskpregnantwomen;(4) Providingsafedeliverytechniqueservicesforpregnantandlying-inwomen.医师发现或者怀疑育龄夫妻患有严重遗传性疾病的，应当提出医学意见；限于现有医疗技术水平难以确诊的，应当向当事人说明情况。育龄夫妻可以选择避孕、节育、不孕等相应的医学措施。第十八条医疗、保健机构应当为孕产妇提供下列医疗保健服务：（一）为孕产妇建立保健手册（

36、卡），定期进行产前检查；（二）为孕产妇提供卫生、营养、心理等方面的医学指导与咨询；（三）对高危孕妇进行重点监护、随访和医疗保健服务；（四）为孕产妇提供安全分娩技术服务；(5)Conductingregularpost-partumvisitsandgivinginstructionsonthescientificwayofbabyfeeding.（五）定期进行产后访视，指导产妇科学喂养婴儿；（六）提供避孕咨询指导和技 术服务；（七）对产妇及其家属进行生 殖健康教育和科学育儿知识教 育；（A）其他孕产期保健服务。第十九条医疗、保健机 构发现孕妇患有下列严重疾病 或者接触物理、化学、生物等 有毒、

37、有害因素，可能危及孕 妇生命安全或者可能严重影响 孕妇健康和胎儿正常发育的， 应当对孕妇进行医学指导和下 列必要的医学检查：(1) Serious pregnancy complications.（一）严重的妊娠合并症或者 并发症；(2) Serious mental diseases.（二）严重的精神性疾病;(3) Other diseases seriously affecting childbearing as set forth by the health administrative department under the State Council.（三）国务院卫生行政部门规 定

38、的严重影响生育的其他疾 病。Article 20 A doctor shall make a prenatal diagnosis where a pregnant woman falls under any of the following circumstances:第二十条孕妇有下列情 形之一的，医师应当对其进行 产前诊断：(1) Polyhydramnios or an hydramnios.（一）羊水过多或者过少的;(6) Providingconsultation,instructionsandtechnicalservicesoncontraception.(7) Givinge

39、ducationonreproductivehealthandthescientificwayofrearingbabiestopost-partumwomenandtheirfamilymembers.(8) Otherhealthcareservicesforthepregnancyandperinatalperiod.Article19Amedicalandhealthcareinstitutionsshall,upondetectingthatapregnantwomancontractsthefollowingseriousillnesses,orcontactswithphysic

40、ally,chemicallyorbiologicallytoxicorharmfulsubstanceswhichmightjeopardizeherlifeorseriouslyaffectherhealthorthenormaldevelopmentofthefetus,givehermedicalinstructionandconductthefollowingnecessarymedicalexaminationforher:(2) Abnormal development of fetus or the fetus being suspected of malformation;（

41、二）胎儿发育异常或者胎儿 有可疑畸形的；(3) Contacting with a substance that might cause congenital defects in the early period of pregnancy;（三）孕早期接触过可能导致 胎儿先天缺陷的物质的；(4) Having family history of genetic diseases or history of giving birth to an infant with a serious congenital defect; or（四）有遗传病家族史或者曾 经分娩过先天性严重缺陷婴儿 的；(5

42、) Being a primipara at the age of 35 or above.（五）初产妇年龄超过35周 岁的。Article21Thecataloguesoftheseriousgeneticdiseasesoffetus,theseriousdefectsoffetusandtheseriousdiseasesofthepregnantwomenwhichmightjeopardizethehealthofthepregnantwomanassetforthbyArticle18oftheLawonMaternalandInfantHealthCareshallbepresc

43、ribedbythehealthadministrativedepartmentundertheStateCouncil.第二十一条母婴保健法 第十八条规定的胎儿的严重遗 传性疾病、胎儿的严重缺陷、 孕妇患继续妊娠可能危及其生 命健康和安全的严重疾病目 录，由国务院卫生行政部门规 定。第二十二条 生育过严重 遗传性疾病或者严重缺陷患儿 的，再次妊娠前，夫妻双方应 当按照国家有关规定到医疗、 保健机构进行医学检查。医 疗、保健机构应当向当事人介 绍有关遗传性疾病的知识，给 予咨询、指导。对诊断患有医 学上认为不宜生育的严重遗传 性疾病的，医师应当向当事人 说明情况，并提出医学意见。Article

44、22Whereawomanhasgivenbirthtoaninfantwithaseriousgeneticdiseaseoraseriousdefect,boththehusbandandwifeshall,priortothewifessecondpregnancy,undergomedicalexaminationinamedicalandhealthcareinstitutioninaccordancewiththerelevantrulesofthestate.Amedicalandhealthcareinstitutionshallcommunicateknowledgeonge

45、neticdiseasestothepartiesandgivethemconsultationandinstructions.Whereapersonisdiagnosedtohavecertaingeneticdiseasemedicallyconsideredinappropriateforchildbearing,thedoctorshallexplainthesituationtothepartiesandgivethemmedicaladvice.第二十三条严禁采用技 术手段对胎儿进行性别鉴定。Article 23 Itisstrictlyprohibitedtoconductge

46、nderidentificationoffetusbytechnicalmeans.对怀疑胎儿可能为伴性遗传 病，需要进行性别鉴定的，由 省、自治区、直辖市人民政府 卫生行政部门指定的医疗、保 健机构按照国务院卫生行政部 门的规定进行鉴定。Whereafetusissuspectedofsufferingfromanysex-linkedgeneticdisease,ifitisnecessarytoconductgenderidentification,suchgenderidentificationshallbemadebyamedicalandhealthcareinstitutiond

47、esignatedbythehealthadministrativedepartmentofthepeople,sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernmentinaccordancewiththeprovisionsofthehealthadministrativedepartmentundertheStateCouncil.第二十四条国家提倡住 院分娩。医疗、保健机构应当 按照国务院卫生行政部门制定 的技术操作规范，实施消毒接 生和新生儿复苏，预防产伤及 产后出血

48、等产科并发症，降低 孕产妇及围产儿发病率、死亡 率。Article 24 Thestateshalladvocatedeliveryinhospital.Medicalandhealthcareinstitutionsshall,inaccordancewiththestandardsofpracticedevelopedbythehealthadministrativedepartmentoftheStateCouncil,provideasepticmidwiferyandresuscitationfornewbornbabies,preventobstetriccomplicationssuchasbirthinjuryandpostpartumhemorrhage,andreducethemorbidityandmortalit
