4、ManagementofHazardousGoodsatPortsonAugust3,2023)ChapterIGeneralProvisionsArticle1Forthepurposesofstrengtheningthesafetymanagementofhazardousgoodsatports,preventingandreducingaccidentsofhazardousgoods,protectingthesafetyofpeople,slivesandproperty,andprotectingtheenvironment,theseProvisionsaredevelope

5、dinaccordancewiththeLawonPorts,theWorkSafetyLaw,theRegulationontheSafetyManagementofHazardousChemicalsandotherrelevantlawsandadministrativeregulations.Article2TheseProvisionsshallapplytothenewconstruction,reconstruction,andexpansionofconstructionprojectsofportsforstorage,loadingandunloadingofhazardo

6、usgoods(hereinafterreferredtoasconstructionprojectsofportsforhazardousgoods),andhazardousgoodsoperationsatportsintheterritoryofthePeopledRepublicofChina.Forthepurposeoftheaforesaidparagraph,hazardousgoodsoperationsatportsincludeloading,unloading,lighteringandstorageofhazardousgoodsinportareas.Articl

7、e3Thesafetymanagementofhazardousgoodsatportsshallbeconductedundertheprinciplesofsafetyfirst,focusingonpreventionandcomprehensivetreatment,andtheprimaryworksafetyresponsibilitiesoftheconstructionentitiesofportconstructionprojectsforhazardousgoodsandportoperatorsshallbestrengthenedandimplemented.第一条为了

8、加强港口危险货物 安全管理，预防和减少危险货物事 故，保障人民生命、财产安全，保护 环境，根据港口法安全生产 法危险化学品安全管理条例等 有关法律、行政法规，制定本规定。第二条 在中华人民共和国境 内，新建、改建、扩建储存、装卸危 险货物的港口建设项目（以下简称危 险货物港口建设项目）和进行危险货 物港口作业，适用本规定。前款所称危险货物港口作业包括在港 区内装卸、过驳、仓储危险货物等行 为。第三条 港口危险货物安全管理 坚持安全第一、预防为主、综合治理 的方针，强化和落实危险货物港口建 设项目的建设单位和港口经营人安全 生产主体责任。危险货物港口建设项目的建设单位和 港口经营人应当建立健全全

9、员安全生 产责任制和安全生产规章制度，加大 对安全生产资金、物资、技术、人员 的投入保障力度，改善安全生产条Constructionentitiesandportoperatorsofconstructionprojectsofportsforhazardousgoodsshallestablishandimprovetheworksafetyresponsibilitysystemandworksafetyrulesandregulationsforallstaffmembers,increasetheinvestmentinandguaranteefortheworksafetyfunds

10、,materials,technology,andpersonnel,improvetheworksafetyconditions,strengthentheworksafetystandardizationandinformationconstruction,establishadualpreventionmechanismforhierarchicalcontrolofsecurityrisksandinvestigationandtreatmentofhiddendangers,improvethemechanismforpreventingandresolvingrisks,impro

11、vethelevelofworksafety,andensureworksafety.件，加强安全生产标准化、信息化建 设，构建安全风险分级管控和隐患排 查治理双重预防机制，健全风险防范 化解机制，提高安全生产水平，确保 安全生产。Article4TheMinistryofTransport(MOT)shallberesponsibleforthesafetyindustry第四条交通运输部主管全国港managementofhazardousgoodsatportsacross危险货物安全行业管理工作。thecountry.Thecompetenttransportdepartmentsoft

12、heprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallbeinchargeofthesafetysupervisionandmanagementofhazardousgoodsatportswithintheirjurisdictions.Theportadministrativedepartmentsattheprovincial,municipalandcountylevelsshallberesponsibleforthespecificimplementationofthe

13、safetysupervisionandmanagementofhazardousgoodsatports.ChapterIISafetyExaminationofConstructionProjectsArticle 5 Constructionprojectsofportsforhazardousgoodsshallbesubjecttoexaminationofthesafetyconditionsbytheportadministrativedepartment.省、自治区、直辖市交通运输主管部 门主管本辖区的港口危险货物安全监 督管理工作。省、市、县级港口行政管理部门在职 责范围内负

14、责具体实施港口危险货物 安全监督管理工作。第二章建设项目安全审查第五条 危险货物港口建设项目 应当由港口行政管理部门进行安全条 件审查。未通过安全条件审查，危险货物港口 建设项目不得开工建设。Aconstructionprojectofportwithhazardousgoodsfailingtopasstheexaminationofsafetyconditionsshallnotbecommenced.Article 6 Theportadministrativedepartmentattheprovinciallevelshallberesponsiblefortheexaminatio

15、nofsafetyconditionsofthefollowingportconstructionprojects:(1) portconstructionprojectsinvolvingthestorageorloadingandunloadingofhighlytoxicchemicals;(2) coastalwharfswithnotlessthan50,000tonsofhazardousgoods,wharfsalongtheYangtzeRivertrunkwithnotlessthan3,000tonsofhazardousgoods,andwharfsalongotheri

16、nlandwaterswithnotlessthan1,000tonsofhazardousgoods;and(3) hazardousgoodsstoragefacilitieswithtotalcapacityofcoastaltankareaofnotlessthan100,000cubicmetersandtotalcapacityofinlandwatertankareaofnotlessthan5,000cubicmeters.Forotherconstructionprojectsofportswithhazardousgoods,theportadministrativedep

17、artmentsatthedistrictedcitylevelintheplacewheretheprojectsarelocatedshallberesponsiblefortheexaminationofsafetyconditions.第六条 省级港口行政管理部门 负责下列港口建设项目的安全条件审 查：（一）涉及储存或者装卸剧毒化学品 的港口建设项目；（二）沿海50000吨级以上、长江干 线3000吨级以上、其他内河1000吨 级以上的危险货物码头；（）沿海罐区总容量100000立方 米以上、内河罐区总容量5000立方 米以上的危险货物仓储设施。其他危险货物港口建设项目由项目所 在地设

18、区的市级港口行政管理部门负 责安全条件审查。第七条 危险货物港口建设项目 的建设单位，应当在可行性研究阶段 按照国家有关规定委托有资质的安全 评价机构对该建设项目进行安全评 价，并编制安全预评价报告。安全预 评价报告应当符合有关安全生产法 律、法规、规章、国家标准、行业标 准和港口建设的有关规定。Article7Theconstructionentityofaconstructionprojectofaportwithhazardousgoodsshall,atthefeasibilitystudystageandinaccordancewiththerelevantprovisionsoft

19、hestate,entrustaqualifiedsafetyevaluationinstitutiontoconductsafetyevaluationoftheconstructionprojectanddevelopasafetypreevaluationreport.Asafetypre-evaluationreportshallcomplywiththerelevantlaws,regulationsandrulesonworksafety,nationalstandards,industrialstandardsandrelevantprovisionsonportconstruc

20、tion.Article8Foraportconstructionprojectinvolvinghazardouschemicals,aconstructionentityshallalsoconductsafetyconditionsdemonstrationanddevelopasafetyconditionsdemonstrationreport.Thecontentsofsafetyconditionsdemonstrationshallinclude:(1) theimpactoftheconstructionprojectsinherentdangersandharmfulfac

21、torsonworksafety;(2) themutualinfluenceinsafetybetweentheconstructionprojectandthesurroundingfacilitiesorentities,denselypopulatedareas,sensitivefacilitiesandenvironmentallysensitiveareas;and(3) theimpactofnaturalconditionsontheconstructionproject.Article9Aconstructionentityshallapplytotheportadmini

22、strativedepartmentintheplacewherethehazardousgoodsconstructionprojectislocatedfortheexaminationofsafetyconditionsandsubmitthefollowingmaterials:(1) theapplicationformforexaminationofthesafetyconditionsoftheconstructionproject;(2) thesafetypre-evaluationreportontheconstructionproject;第八条 涉及危险化学品的港口 建

23、设项目，建设单位还应当进行安全 条件论证，并编制安全条件论证报 告。安全条件论证的内容应当包括：（一）建设项目内在的危险和有害因 素对安全生产的影响；（二）建设项目与周边设施或者单 位、人员密集区、敏感性设施和敏感 环境区域在安全方面的相互影响；（三）自然条件对建设项目的影响。第九条建设单位应当向危险货 物建设项目所在地港口行政管理部门 申请安全条件审查，并提交以下材 料：（一）建设项目安全条件审查申请 书；（二）建设项目安全预评价报告；（三）建设项目安全条件论证报告(3) thesafetyconditiondemonstrationreportontheconstructionprojec

24、t(wherehazardouschemicalsareinvolved);and(4) theconstructionprojectplanningandsiteselectiondocumentsrequiredtobeobtainedaccordingtothelaw.Theportadministrativedepartmentintheplacewhereitislocatedshallcheckwhetherthedocumentsarecompleteandnotifytheapplicantofmakingsupplementsandcorrectionswherethemat

25、erialsareincomplete.Anapplicationwithcompletematerialsshallbeaccepted;andforanapplicationnotfallingunderthescopeoftheexaminationpoweratthecorrespondinglevel,theapplicationmaterialsshallbeforwardedtotheportadministrativedepartmentwiththeexaminationpowerwithin5daysaftertheacceptance.Theforwardingtimes

26、hallbeincludedinthetimelimitforexamination.Article10Theportadministrativedepartmentinchargeoftheexaminationofsafetyconditionsshallmakeanexaminationdecisionwithin45daysoftheacceptanceofanapplication.Underoneofthefollowingcircumstances,theexaminationofsafetyconditionsisnotpassed:(1) Asafetypre-evaluat

27、ionreporthasamajorflawandmissingitem,includingincompleteorinaccurateidentificationandevaluationofthemajorhazardousandharmfulfactorsoftheconstructionproject.（涉及危险化学品的提供）；（四）依法需取得的建设项目规划选 址文件。所在地港口行政管理部门应当核查文 件是否齐全，不齐全的告知申请人予 以补正。对材料齐全的申请应当予以 受理；对不属于本级审查权限的，应 当在受理后5日内将申请材料转报有 审查权限的港口行政管理部门。转报 时间应当计入审查

28、期限。第十条 负责安全条件审查的港 口行政管理部门应当自受理申请之日 起45日内作出审查决定。有下列情形之一的，安全条件审查不 予通过：（一）安全预评价报告存在重大缺 陷、漏项的，包括对建设项目主要危 险、有害因素的辨识和评价不全面或 者不准确的；（二）对安全预评价报告中安全设施 设计提出的对策与建议不符合有关安(2) Thecountermeasuresandsuggestionsofferedinthedesignofsafetyfacilitiesinthesafetypre-evaluationreportdonotconformtotherelevantlaws,regulation

29、sandrulesonworksafety,nationalstandards,orindustrialstandards.全生产法律、法规、规章和国家标准、行业标准的；(3) Thedistancebetweentheconstructionprojectandthesurroundingplacesandfacilitiesorthenaturalconditionsoftheproposedsitedoesnotconformtotherelevantlaws,regulationsandrulesonworksafety,nationalstandards,orindustrialst

30、andards.(4) Themajortechnologiesandtechniquesarenotdeterminedordonotconformtotherelevantlaws,regulationsandrulesonworksafety,nationalstandards,orindustrialstandards.(5) Safetyconditionsdemonstrationorsafetyevaluationisnotconductedaccordingtothelaw.(6) Relevantsituationisconcealedorfalsedocumentsandm

31、aterialsareprovided.Theportadministrativedepartmentshall,duringtheprocessoftheexaminationofsafetyconditions,examinetheapplicationmaterialsandverifythesite.Ifnecessary,therelevantexpertsmaybeorganizedtoconductconsultationanddemonstration.（三）建设项目与周边场所、设施的距离或者拟建场址自然条件不符合有关安全生产法律、法规、规章和国家标准、行业标准的；（四）主要技

32、术、工艺未确定，或者不符合有关安全生产法律、法规、规章和国家标准、行业标准的；（五）未依法进行安全条件论证和安全评价的；（六）隐瞒有关情况或者提供虚假文件、资料的。港口行政管理部门在安全条件审查过程中，应当对申请材料进行审查，并对现场进行核查。必要时可以组织相关专家进行咨询论证。Article11Theportadministrativedepartmentshallapprovethepassingofthoseconformingtothesafetyconditionsandservetheapplicantswithexaminationdecisions.Wheretheexamin

33、ationofsafetyconditionsisnotpassed,thereasonsshallbespecifiedandtheapplicantsshallbenotified.Aconstructionentitymay,第十一条港口行政管理部门对符合安全条件的，应当予以通过，并将审查决定送达申请人。对未通过安全条件审查的，应当说明理由并告知申请人。建设单位经过整改后可以重新申请安全条件审查。aftermakingrectification,re-applyforexaminationofsafetyconditions.第十二条已经通过安全条件审 查的危险货物港口建设项目有下列情

34、形之一的，建设单位应当按照本规定 的有关要求重新进行安全条件论证和 安全评价，并重新申请安全条件审 查：Article12Whereaconstructionprojectofportwithhazardousgoodswhichhaspassedtheexaminationofsafetyconditionsfallsunderoneofthefollowingcircumstances,theconstructionentityshallconductnewsafetyconditiondemonstrationandnewsafetyevaluationundertherelevantr

35、equirementsasspecifiedintheseProvisionsandreapplyforexaminationofsafetyconditions:（一）变更建设地址的;(1) Thesiteofconstructionischanged.（二）建设项目周边环境因素发生重 大变化导致安全风险增加的；(2) Theoccurrenceofmajorchangesinthesurroundingenvironmentalfactorsoftheconstructionprojecthasledtotheincreaseinthesafetyrisks.（）建设项目规模进行调整导致安

36、 全风险增加或者安全性能降低的；(3) Theadjustmenttotheconstructionprojecthasledtotheincreaseinthesafetyriskordecreaseofthesafetyperformance.（四）建设项目平面布置、作业货 种、工艺、设备设施等发生重大变化 导致安全风险增加或者安全性能降低 的。(4) Significantchangeintheplanelayout,typesofthegoodsoperated,technologies,equipmentandfacilitiesandotheritemshasledtotheinc

37、reaseinthesafetyriskordecreaseofthesafetyperformance.第十三条建设单位应当在危险 货物港口建设项目初步设计阶段按照 国家有关规定委托设计单位对安全设 施进行设计。Article13Aconstructionentityshall,atthepreliminarydesignstageofaconstructionprojectofportwithhazardousgoods,entrustadesignentitytodesignthesafetyfacilitiesinaccordancewiththerelevantprovisionso

38、fthestate.安全设施设计应当符合有关安全生产Safetyfacilitiesshallbedesignedtoconformto和港口建设的法律、法规、规章以及 国家标准、行业标准，并包括以下主 要内容：thelaws,regulationsandrulesonworksafetyandportconstruction,nationalstandardsandindustrialstandards,andincludethefollowingmaincontents:（一）该建设项目涉及的危险、有害 因素和程度及周边环境安全分析；(1) theanalysisonthehazardou

39、sandharmfulfactorsinvolvedintheconstructionproject,thedegreeandthesafetyofthesurroundingenvironment;（二）采用的安全设施和措施，预期 效果以及存在的问题与建议；(2) thesafetyfacilitiesandmeasuresadopted,theexpectedresultsandtheexistingproblemsandrecommendations;（三）对安全预评价报告中有关安全 设施设计的对策与建议的采纳情况说 明；(3) theexplanationfortheadoptiono

40、fthecountermeasuresandrecommendationsonthedesignofsafetyfacilitiesinthesafetypreevaluationreport;and（四）可能出现的事故预防及应急救 援措施。(4) thepreventionandemergencyrescuemeasuresforpossibleaccidents.第十四条 由港口行政管理部门 负责初步设计审批的危险货物港口建 设项目，在初步设计审批中对安全设 施设计进行审查。Article14Theportadministrativedepartmentshallberesponsible

41、fortheconstructionprojectsofportswithhazardousgoodspreliminarilydesignedandapprovedandexaminethedesignofsafetyfacilitiesinthepreliminarydesignandapproval.前款规定之外的其他危险货物港口建 设项目，由负责安全条件审查的港口 行政管理部门进行安全设施设计审 查。Theportadministrativedepartmentinchargeoftheexaminationofsafetyconditionsshallexaminethedesign

42、ofsafetyfacilitiesforconstructionprojectsofportswithhazardousgoodsotherthanthoseprescribedintheprecedingparagraph.建设单位在申请安全设施设计审查时Toapplyfortheexaminationofthedesignofsafetyfacilities,aconstructionentityshallsubmitthefollowingmaterials:(1) anApplicationFormfortheExaminationofDesignofSafetyFacilities

43、;(2) theprofileandcreditstatusofthedesignentity;and(3) thedesignofthesafetyfacilities.Aportadministrativedepartmentshall,within20daysoftheacceptanceofanapplication,makeadecisionofexaminationandnotifytheapplicant;andmayextend10daysandnotifytheapplicantofthereasonsforextendingthetimelimit,withtheappro

44、valofthepersoninchargeofthedepartment,ifadecisionisunabletobemadewithin20days.Article15Underoneofthefollowingcircumstances,theexaminationofthedesignofsafetyfacilitiesisnotpassed:应当提交以下材料:（一）安全设施设计审查申请书;（二）设计单位的基本情况及资信情 况；（三）安全设施设计。港口行政管理部门应当自受理申请之 日起20日内对申请材料进行审查， 作出审查决定，并告知申请人；20日 内不能作出决定的，经本部门负责人

45、批准，可以延长10日，并应当将延 长期限的理由告知申请人。第十五条有下列情形之一的, 安全设施设计审查不予通过：(1)Thequalificationsofthedesignentitydonot(一)设计单位资质不符合相关规定conformtotherelevantprovisions.的；(2) The design is not conducted in accordance with the relevant laws, regulations, rules, national standards, or industrial standards.（二）未按照有关法律、法规、规章和国家

46、标准、行业标准的规定进行设计的；（三）对未采纳安全预评价报告中的 安全对策和建议，未作充分论证说明 的；(3) Sufficientdemonstrationorexplanationisnotconductedormadeforfailuretoadoptthesafetycountermeasuresandsuggestionsinthesafetypre-evaluationreport.（四）隐瞒有关情况或者提供虚假文 件、资料的。(4) Relevantsituationisconcealedorfalsedocumentsandmaterialsareprovided.安全设施设计

47、审查未通过的，建设单 位经过整改后可以重新申请安全设施 设计审查。Wheretheexaminationofthedesignofsafetyfacilitiesisnotpassed,aconstructionentitymay,afterrectification,re-applyfortheexaminationofthedesignofsafetyfacilities.第十六条已经通过审查的危险 货物港口建设项目安全设施设计有下 列情形之一的，建设单位应当报原审 查部门重新申请安全设施设计审查：Article16Wherethedesignofsafetyfacilitiesofaco

48、nstructionprojectofportwithhazardousgoodswhichhaspassedtheexaminationfallsunderoneofthefollowingcircumstances,theconstructionentityshallreporttotheoriginalexaminationdepartmentandreapplyfortheexaminationofthedesignofsafetyfacilities:（一）改变安全设施设计且可能导致 安全性能降低的；(1) Thedesignofsafetyfacilitiesischanged,whichmayleadtothedecreaseofsafetyperformance.（二）在施工期间重新设计的。(2) Redesignisconductedduringtheconstructionperiod.第十七条 危险货物港口建设项 目的建设单位应当在施工期间组织落 实经批准的安全设施设计的有关内 容，并加强对施工质量的监测和管 理，建立相应
