7、yandhonest1.ywithinthereasonab1.etimeperiod.Anypartywhocannotindependent1.yco1.1.ectevidencesduetoobjectivereasonsmayrequestthePeop1.escourttoco1.1.ectafterinvestigations.Artic1.e4Theburdenofproofinthetortactionssha1.1.beassumedaccordingtothefo1.1.owingru1.es:1. Inapatentinfringementactionresu1.ting

8、fromtheinnovation-creationofwaysofproducingnewproducts,theentityorindividua1.thatproducesthesameproductsha1.1.provethatthewaysusedaredifferentfromthoseofthepatentho1.der;2. Inaninfringementactionresu1.tingfrompersona1.damagecausedbyhigh1.ydangerousoperations,theinfringingpersonsha1.1.beresponsib1.ef

14、Artic1.e5Inacontractua1.dispute,thepartythatc1.aimstheestab1.ishmentofcontractua1.re1.ationshipandthecontracthastakeneffectsha1.1.beresponsib1.eforproducingevidencestoprovethatthecontracthasbeenconc1.udedandthatithastakeneffect;thepartythatc1.aimsthatthecontracthasbeena1.tered,disso1.ved,terminatedo

15、rcance1.edsha1.1.beresponsib1.eforproducingevidencestoprovethechangesofthecontract.Inadisputeoverwhetheracontractisperformed,thepartyundertheob1.igationofperformingthecontractsha1.1.beresponsib1.eforproducingevidences;Inadisputeoverthepowerofagency,thepartythatc1.aimstheexistenceofsuchpowersha1.1.be

17、ences.Article 7 Wheretherearenoexp1.icitstatutoryprovisionsanditisnotpossib1.etodefinewhosha1.1.beresponsib1.eforproducingevidencesaccordingtothepresentProvisionsorOtherjudicia1.interpretations,thePeop1.escourtmaydeterminetheburdenofproofaccordingtotheprincip1.eoffairnessandtheprincip1.eofhonestyand

18、creditandtakingsuche1.ementsastheabi1.itytoproduceevidencesintoconsideration.Article 8 IntheprocessofIitigation3ifapartyexp1.icit1.yacknow1.edgesthefactsa1.1.egedbytheotherparty,theotherpartyneedsnottoproduceevidenceswith,however,theexceptionofcasesthatinvo1.vespersona1.identification.Iftheotherpart

19、yneitheracknow1.edgesnordeniesthefactsa1.1.egedbyapartyandsti1.1.fai1.stoexp1.icit1.yexpressesconfirmationordenia1.afterthejudgehasmadeadequateaccountsandinquiries,itsha1.1.bedeemedasconfirmingthesaidfacts.Ifanyofthepartiesconcernedentrustsagentstoparticipateinthe1.itigation,theaffirmationoftheagent

20、sha1.1.bethatofthepartiesconcerned,however,withtheexceptionoftheaffirmationoffactsmadebytheagentwithoutspecia1.authorizationthat1.eadstotheaffirmationofthe1.itigationa1.1.egationsoftheotherparty.Ifthepartyconcernedispresentbutfai1.stodenytheaffirmationmadebytheagentthereof,theaffirmationsha1.1.bedee

21、medastheaffirmationofthepartyconcerned.Ifanyofthepartiesconcernedwithdrawsitsaffirmationandobtainstheapprova1.oftheotherpartypriortotheendofcourtdebate,orhasadequateevidencestoprovethatitsaffirmationhasbeenmadeduetothreatorgrossmisunderstandingortheaffirmationisnotconsistentwiththefacts,thepartyconc

22、ernedsha1.1.notbeexemptedfromtheburdenofproof.Article 9 Thefactsasmentionedbe1.owneednotbeprovedbythepartiesconcernedbypresentingevidences:1. Thefactsthatareknowbya1.1.peop1.e;2. Natura1.1.awsandtheorems;3. Thefactthatcanbeinducedaccordingto1.ega1.provisionsorknownfactsortheru1.eofexperienceofdai1.y

24、ontraryevidencesofthepartiesconcerned.Artic1.e10WhenproducingevidencestothePeop1.escourt,thepartiesconcernedsha1.1.submittheorigina1.documentororigina1.thing.Ifthepartyconcernedneedtopreservetheorigina1.documentororigina1.thingoftheevidenceorifitisdifficu1.ttosubmittheorigina1.documentororigina1.thi

25、ng,aphotocopyorreproductionthathasbeendeemedastheorigina1.bythePeop1.e,scourtafterverificationmaybesubmitted.thecaseofareproductionoraphoto,theinvestigationnotessha1.1.specifyhowtheevidenceisobtained.Artic1.e22Theinvestigatorswhoinvestigateuponandco1.1.ectcomputerdataoraudio-visua1.materia1.ssuchass

26、oundArtic1.e37ThePeop1.escourtmay,upontheapp1.icationofthepartiesconcerned,arrangeforthemtoexchangeevidencespriortoho1.dingasessionofcourthearing.Asforthecasesforwhichtherearep1.entyofevidencesorwhicharedifficu1.tinnature,thePeop1.escourtsha1.1.arrangeforthepartiesconcernedtoexchangeevidencesafterth

27、eexpirationofthetimeperiodforrep1.ybutpriortoho1.dingasessionofcourthearing.Article 38 Thetimeforexchangingevidencesmaybeagreeduponbythepartiesconcernedandbesubjecttotheapprova1.ofthePeop1.escourt,oritmaybedeterminedbythePeop1.escourt.WherethePeop1.escourtarrangesforthepartiesconcernedtoexchangeevid
