Inapatentinfringementactionresu1.tingfromtheinnovation-creationofwaysofproducingnewproducts,theentityorindividua1.thatproducesthesameproductsha1.1.provethatthewaysusedaredifferentfromthoseofthepatentho1.der;2. Inaninfringementactionresu1.tingfrompersona1.damagecausedbyhigh1.ydangerousoperations,theinfringingpersonsha1.1.beresponsib1.eforproducingevidencestoprovethatargumentthatthevictimcausedtheinjury;3. Inaninfringementactionofdamagescausedbymedica1.acts,themedica1.institutionsha1.1.beresponsib1.eforproducingevidencestoprovethatthereisnocausa1.re1.ationshipbetweenthemedica1.actandtheharmfu1.consequencesoritisnotatfau1.t.Wheretherearespecia1.provisionsinre1.evant1.awsconcerningtheproducingofevidences,suchprovisionssha1.1.prevai1.Artic1.e5Inacontractua1.dispute,thepartythatc1.aimstheestab1.ishmentofcontractua1.re1.ationshipandthecontracthastakeneffectsha1.1.beresponsib1.eforproducingevidencestoprovethatthecontracthasbeenconc1.udedandthatithastakeneffect;thepartythatc1.aimsthatthecontracthasbeena1.tered,disso1.ved,terminatedorcance1.edsha1.1.beresponsib1.eforproducingevidencestoprovethechangesofthecontract.Inadisputeoverwhetheracontractisperformed,thepartyundertheob1.igationofperformingthecontractsha1.1.beresponsib1.eforproducingevidences;Inadisputeoverthepowerofagency,thepartythatc1.aimstheexistenceofsuchpowersha1.1.beresponsib1.eforproducingevidences.Artic1.e6Inadisputeof1.abor,ifthedisputeiscausedbytheemp1.oyingentity,sdecisionofkickout,remova1.fromthenamero1.1.,dismissa1.,disso1.utionofcontract,reducingremuneration,ca1.cu1.ationofworkingyearsoftheIaborer3theemp1.oyingentitysha1.1.beresponsib1.eforproducingevidences.Article 7 Wheretherearenoexp1.icitstatutoryprovisionsanditisnotpossib1.etodefinewhosha1.1.beresponsib1.eforproducingevidencesaccordingtothepresentProvisionsorOtherjudicia1.interpretations,thePeop1.e'scourtmaydeterminetheburdenofproofaccordingtotheprincip1.eoffairnessandtheprincip1.eofhonestyandcreditandtakingsuche1.ementsastheabi1.itytoproduceevidencesintoconsideration.Article 8 IntheprocessofIitigation3ifapartyexp1.icit1.yacknow1.edgesthefactsa1.1.egedbytheotherparty,theotherpartyneedsnottoproduceevidenceswith,however,theexceptionofcasesthatinvo1.vespersona1.identification.Iftheotherpartyneitheracknow1.edgesnordeniesthefactsa1.1.egedbyapartyandsti1.1.fai1.stoexp1.icit1.yexpressesconfirmationordenia1.afterthejudgehasmadeadequateaccountsandinquiries,itsha1.1.bedeemedasconfirmingthesaidfacts.Ifanyofthepartiesconcernedentrustsagentstoparticipateinthe1.itigation,theaffirmationoftheagentsha1.1.bethatofthepartiesconcerned,however,withtheexceptionoftheaffirmationoffactsmadebytheagentwithoutspecia1.authorizationthat1.eadstotheaffirmationofthe1.itigationa1.1.egationsoftheotherparty.Ifthepartyconcernedispresentbutfai1.stodenytheaffirmationmadebytheagentthereof,theaffirmationsha1.1.bedeemedastheaffirmationofthepartyconcerned.Ifanyofthepartiesconcernedwithdrawsitsaffirmationandobtainstheapprova1.oftheotherpartypriortotheendofcourtdebate,orhasadequateevidencestoprovethatitsaffirmationhasbeenmadeduetothreatorgrossmisunderstandingortheaffirmationisnotconsistentwiththefacts,thepartyconcernedsha1.1.notbeexemptedfromtheburdenofproof.Article 9 Thefactsasmentionedbe1.owneednotbeprovedbythepartiesconcernedbypresentingevidences:1. Thefactsthatareknowbya1.1.peop1.e;2. Natura1.1.awsandtheorems;3. Thefactthatcanbeinducedaccordingto1.ega1.provisionsorknownfactsortheru1.eofexperienceofdai1.y1.ife;4. ThefactsaffirmedinthejudgmentofthePeop1.e'scourtthathastakeneffect;5. Thefactsaffirmedintheawardofthearbitrationorganthathastakeneffect;6. Thefactsthathavebeenprovedintheva1.idnotarydocuments.Thefactsasmentionedinitems1,3,4,5,6oftheprecedingparagraphsha1.1.beexc1.udediftheycanbeoverthrownbycontraryevidencesofthepartiesconcerned.Artic1.e10WhenproducingevidencestothePeop1.e'scourt,thepartiesconcernedsha1.1.submittheorigina1.documentororigina1.thing.Ifthepartyconcernedneedtopreservetheorigina1.documentororigina1.thingoftheevidenceorifitisdifficu1.ttosubmittheorigina1.documentororigina1.thing,aphotocopyorreproductionthathasbeendeemedastheorigina1.bythePeop1.e,scourtafterverificationmaybesubmitted.thecaseofareproductionoraphoto,theinvestigationnotessha1.1.specifyhowtheevidenceisobtained.Artic1.e22Theinvestigatorswhoinvestigateuponandco1.1.ectcomputerdataoraudio-visua1.materia1.ssuchassoundArtic1.e37ThePeop1.e'scourtmay,upontheapp1.icationofthepartiesconcerned,arrangeforthemtoexchangeevidencespriortoho1.dingasessionofcourthearing.Asforthecasesforwhichtherearep1.entyofevidencesorwhicharedifficu1.tinnature,thePeop1.e'scourtsha1.1.arrangeforthepartiesconcernedtoexchangeevidencesaftertheexpirationofthetimeperiodforrep1.ybutpriortoho1.dingasessionofcourthearing.Article 38 Thetimeforexchangingevidencesmaybeagreeduponbythepartiesconcernedandbesubjecttotheapprova1.ofthePeop1.e'scourt,oritmaybedeterminedbythePeop1.e'scourt.WherethePeop1.e'scourtarrangesforthepartiesconcernedtoexchangeevidences,thedaywhenevidencesareexchangedisthedaywhenthetimeperiodforproducingevidencesexpires.Wheretheapp1.icationofthepartiesconcernedforextendingthetimeperiodforproducingevidencesisapprovedbythePeop1.e'scourt,thedateforexchangingevidencessha1.1.a1.sobeextendedaccording1.y.Article 39 Theexchangeofevidencessha1.1.beconductedunderthechargeofthejudges.Intheprocessofchangingevidences,thejudgessha1.1.recordinthecasefi1.esthefactsandevidencestowhichthepartiesconcernedhavenoobjection.Iftheyhaveanyobjectiontoanyoftheevidences,suchevidencessha1.1.berecordeddownaccordingtothec1.assifiedfactsthatneedtobeprovedandsha1.1.specifythereasonsforsuchobjection.Throughtheexchangeofevidences,themajorissuesaboutthedisputesofbothpartiesconcernedaredetermined.Article 40 Whereanypartyconcernedrebutsandsubmitsnewevidencesafterreceivingtheevidencesexchangedbytheotherparty,thePeop1.e'scourtsha1.1.informthemtoexchangethenewevidencesatadesignatedtime.Asagenera1.ru1.es,theresha1.1.notbemorethantwoexchangesofevidences,un1.essthecaseisveryimportant,difficu1.torverycomp1.icatedinnatureandthePeop1.e'scourtbe1.ievesitnecessarytohaveanotherexchangeofevidences.Article 41 The"newevidencesasprovidedinparagraph1ofArtiC1.e125oftheCiVi1.PrOCed1.Ire1.aWsha1.1.refertoanyofthefo1.1.owingcircumstances:1. Thenewevidencesofthefirstinstancehearinginc1.ude:theevidencesnew1.yfoundbythepartiesconcernedaftertheexpirationofthetimeperiodforproducingevidencesinthefirstinstancecourthearing;theevidenceswhichthepartiesconcernedcannotprovideduringthetimeperiodforproducingevidencesduetoobjectivereasonsandsti1.1.cannotprovideduringtheextendedtimeperiodapprovedbythePeop1.e'scourt;2. Thenewevidencesofthesecondinstancehearinginc1.ude:theevidencesnew1.yfoundafterthefirstinstanceshearingisfinished;theevidenceswhichthepartiesconcernedapp1.ied,priortotheexpirationofthetimeperiodforproducingevidencesinthefirstinstancehearing,tothePeop1.e'scourtforinvestigationandco1.1.ectionbutfai1.edtobeapprovedbutco1.1.ectedbythesecondinstancecourtupontheapp1.icationofthepartiesconcernedwhichbe1.ievesitnecessarytograntapprova1.totheapp1.icationthereof.Artic1.e42Whereanypartyconcernedsubmitsnewevidencesinthefirstinstancehearing,suchevidencessha1.1.besubmittedpriortothestartofthefirstinstancehearingorpriortotheho1.dingofasession.Whereanypartyconcernedsubmitsnewevidencesintheprocessofthesecondinstancehearing,suchevidencessha1.1.besubmittedpriortothestartofthesecondinstanceorpriortotheho1.dingofasession.Whereitisnotnecessarytoho1.dasession,theysha1.1.besubmittedduringthetimeperioddesignatedbythePeop1.e'scourt.Artic1.e43Wheretheevidencessubmittedbythepartiesconcernedafterthetimeperiodforproducingevidencesexpiresarenotnewevidences,theysha1.1.notbeacceptedbythePeop1.e'scourt.Whereanyevidencefai1.stobeprovidedbythepartiesconcernedduringtheextendedtimeperiodupontheapprova1.ofthePeop1.e'scourtduetoobjectivereasonsandthefai1.uretohearsuchevidencemayresu1.tininjustice,suchevidencemaybedeemedasnewevidence.Artic1.e44Theterm"newevidences"asmentionedinItem1,Paragraph1ofArtiCIe179oftheCiVi1.PrOCedure1.aWsha1.1.refertotheevidencesnew1.yfoundafterthecourthearingoftheorigina1.instanceisfinished.Whereanypartyconcernedsubmitsnewevidencesintheprocessofretria1.,itsha1.1.submitsuchevidenceswhenitapp1.iesforretria1.Artic1.e45Whereanypartyconcernedproducesnewevidences,thePeop1.e'scourtsha1.1.informtheotherpartytoputforwarditsopinionsorproduceevidencesduringareasonab1.eperiodoftime.Artic1.e46Whereacaseisremandedforanewtria1.orthejudgmentofwhichischangedduringthesecondtria1.orretria1.asaresu1.tthatanypartyconcernedfai1.edtoproduceevidencesduringtheprescribedtime1.imit,theorigina1.judgmentsha1.1.notbeconsideredtobeawrongjudgment.Whereapartyp1.eadsthattheotherpartythatproducesnewevidencesbearthereasonab1.eexpensesincurredfromthetrave1.ing,1.ossofworkingtime,thewitness'sappearanceatcourt,Iitigation3etc.andthedirect1.ossesincurredtherefrom,suchp1.eadingssha1.1.beaffirmedbythePeop1.e'scourt.IV.Cross-ExaminationArtic1.e47Evidencessha1.1.bepresentedatcourtandbecross-examinedbythepartiesconcerned.Anyevidencethathasnotbeencross-examinedsha1.1.notberenderedasthebasisforaffirmingthefactsofthecase.Theevidencesthatareaffirmedandrecordeddowninthecasefi1.esintheprocessofexchangingevidencesmay,uponthestatementOfjudgesatcourthearing,betakenasthebasisforaffirmingthefactsofthecase.Artic1.e48Theevidencesthatinvo1.vethestatesecrets,businesssecrets,persona1.privacyorotherevidencesthatsha1.1.bekeptsecretaccordingtore1.evantprovisionsof1.awmaynotbecross-examinedinpub1.icatthecourthearings.Artic1.e49Whencross-examiningwrittenevidences,physica1.evidencesoraudio-visua1.materia1.s,thepartiesconcernedsha1.1.beentit1.edtodemandtheotherpartytopresenttheorigina1.documentororigina1.thingwiththeexceptofanyofthefo1.1.owingcircumstances:1. Itisindeeddifficu1.ttopresenttheorigina1.documentororigina1.thinganditisapprovedbythePeop1.e'scourttopresentthereproductionorphotocopythereof;2. Theorigina1.documentororigina1.thingisnotexistingbutevidencesshowthattheproductionorphotocopyisidentica1.totheorigina1.documentororigina1.thing.Artic1.e50Whencross-examiningevidences,thepartiesconcernedsha1.1.concentrateonthegenuineness,re1.ativity,1.awfu1.nessoftheevidences,andmakeinterrogations,accountsanddebatesconcerningtheva1.idityandforcefu1.nessoftheevidences.Article 51 Thecross-examinationsha1.1.beconductedinthefo1.1.owingsequence:1. Thep1.aintiffpresentsevidences,andthedefendantorthirdpartycross-examines;2. Thedefendantpresentsevidences,andthep1.aintifforthirdpartycross-examines;3.
