5、障社会主义市场经济健康开展，制定本法。Article 2 Contractua1.disputesandotherdisputesoverrightsandinterestsinpropertybetweencitizens,1.ega1.personsandotherorganizationsthatareequa1.subjectsmaybearbitrated.第二条平等主体的公民、法人和其他组织之间发生的合同纠纷和其他财产权益纠纷，可以仲裁。Article 3 Thefo1.1.owingdisputesmaynotbearbitrated:第三条以下纨纷不能仲裁：(1.)marita

19、thbe1.ow:仲裁员应当符合以下条件之一：(I)TohavebeenengagedinarbiIrationworkforat1.easteightyears;(一)从事仲裁工作满八年的：(2)Tohaveworkedasa1.awyerforat1.easteightyears：(一)从事律师工作满八年的：(3)Tohaveservedasajudgeforat1.easteightyears;()曾任审判员满八年的；(4)Tohavebeenengagedin1.ega1.researchor1.ega1.education,possessingaseniorprofessiona1.

20、tit1.e;or(四)从事法律研究、教学工作并具有高级职称的：(5)Tohaveacquiredtheknow1.edgeof1.aw,engagedintheprofessiona1.workinthefie1.dofeconomyandtrade,etc.,possessingaseniorprofessiona1.tit1.eorhavinganequiva1.entprofessiona1.1.eve1.五)具有法律知识、从事经济贸易等专业工作并具有高级职称或者具有同等专业水平的。Anarbitrationcommissionsha1.1havearegisterofarbitrat

24、进行监督。China.Arbitration.Associationsha1.1.formu1.ateru1.esofarbitrationinaccordancewiththis1.awandIhere1.evantprovisionsoftheCivi1.Procedure1.aw.中国仲裁协会依照本法和民事诉讼法的有关规定制定仲裁规则。ChapterIIIArbitrationAgreMDent第三章仲裁出议Artic1.e16Anarbitrationagreementsha1.1.inc1.udeubiIra1.ionc1.ausesstipu1.atedinthecontracta

25、ndagreementsofsubmissiontoarbitrationthatareconc1.udedinotherwrittenformsbeforeorafterdisputesarise.第十六条仲裁协议包括合同中订立的仲裁条款和以其他书面方式在纠纷发生前或者纠黝发生后达成的请求仲裁的协议。narbitrationagreementsha1.1containthefo1.1.owinparticu1.ars:仲裁协议应当具有以下内容：(1.)anexpressionofintentiontoapp1.yforarbitration：(2)mttersorarbitration;an

26、d(3)adesignatedarbitrationcommission.-)请求仲裁的意思表示；(一)仲裁事项：(三)选定的仲裁委员会Artic1.e17Anarbitrationagreementsha1.1.benu1.1.andvoidunderoneofthefo1.1.owingcircumstances:第十七条有以下情形之一的，仲裁协议无效：(I)TheagreedmattersforarbitrationexceedtherangeofarbiUcib1.emai1.ersasSPeCifiedby1.aw;(一)约定的仲裁事项超出法律规定的仲裁范围的：(2)Oneparty

27、thatconc1.udedthearbitrationagreementhasnocapacityforcivi1conductsorhas1.imitedcapacityforcivi1.conducts：or(二)无民事行为能力人或者限制民事行为能力人订立的仲裁协议：(3)Onepartycoercedtheotherpartyintoconc1.udingthearbitrationagreement.(三)-方采取胁迫手段,迫使对方订立仲裁协议的。Artic1.e18Ifanarbitrationagreementcontainsnoorunc1.earprovisionsconce

28、rningthemattersforarbiIra1.ionorIhearbitrationcommission,thepartiesmayreachasupp1.ementaryagreement.Ifnosuchsupp1.ementaryagreementcanbereached,thearbitrationagreementsha1.1.benu1.1andvoid.第十八条仲裁协议对仲战事项或者仲裁委员会没有约定或者约定不明确的，当事人可以补充协议:达不成补充协议的，仲裁协议无效。Artic1.e19Anarbitrationagreementsha1.1existindepende

35、itisbased;and(二)仲裁请求和所根据的事实、理由：(3)theevidence,thesourceoftheevidenceandthenamesanddomici1.esofwitnesses.(三)证据和证据来源、证人姓名和住所。Artic1.e21Whenanarbitra1.ioncommissionreceivesawrittenapp1.icationforarbitrationandconsidersthattheapp1.icationcomp1.ieswiththeconditionsforacceptance,itsha1.1accepttheapp1.icat

36、ionandnotifythepartywithinfivedaysfromthedateofreceipt.IfthearbiIrationcommissionconsidersthattheapp1.icationdoesnotcomp1.ywiththeconditionsforacceptance,itsha1.1.informthepartyinwritingofitsrejectionoftheapp1.icationandexp1.ainthereasonsforrejectionwithinfivedaysfromthedateofreceipt.第二十四条仲裁委员会收到仲裁申

40、ceedings.被申请人收到仲裁申请书副本后，应当在仲裁规则规定的期限内向仲裁委员会提交辩论书。仲裁委员会收到辩论节后，应当在仲裁规则规定的期限内将辩论书副本送达申请人.被申请人未提交辩论书的，不影响仲裁程序的进行。Artic1.e26Ifthepartieshaveconc1.udedanarbitrationagreementandonepartyhasinstitutedanactioninapeop1.e,scourtwithoutdec1.aringtheexistenceofthearbitrationagreementand,afterthepeop1.escourthasac

41、ceptedthecase,theotherpartysubmitsthearbitrationUgreemenIpriortoIheirs1.hearing,thepeop1.e,scourtsha1.1.dismissthecaseun1.essthearbitrationagreementisnu1.1.andvoid.If,priortothefirsthearing,theotherpartyhasnotraisedanobjectiontothepeop1.e,Scourt,sacceptanceofthecase,hesha1.1bedeemedtohaverenouncedth

42、earbitrationagreementandthepeop1.escourtsha1.1.continuetotrythecase.第二十六条当事人达成仲裁协议，一方向人民法院起诉未声明有仲裁协议，人民法院受理后，另一方在苜次开庭前提交仲裁协议的，人民法院应当咬回起诉，但仲裁协议无效的除外：另一方在首次开庭前未对人民法院受理该案提出异议的，视为放弃仲裁协设，人民法院应当继续审理。Artic1.e27Thec1.aimantmayrenounceoramenditsarbitrationc1.aim.Therespondentmayacceptorrefuseanarbitrationc1.
