14、iminalProcedure1.awofthePeoplesRepublicofChina,theOversight1.awofthePeoplesRepublicofChina,andotherapplicablelawsforthepurposesofsafeguardingnationaljudicialsovereignty,regulatingtheproceduresforinternationaljudicialassistanceincriminalmatters,andimprovingworkqualityandefficiency.国家监察委员会最高人民法院最高人民检察

15、院外交部公安部国家安全部司法部2024年4月22日关于实施中华人艮共和国国际刑事司法协助法若干问题的规定（试行）笫一条为维护国家司法主权，规范国际刑事司法协助程序，提高工作质量和效率，根据中华人民共有国国际刑事司法协助法中华人民共和国刑事诉讼法中华人民共和国监察法等法律，制定本规定。第二条对外联系机关收到外国提出的刑事司法协助请求后，应当及时对请求Article2Afterreceivingaforeigncountrysrequestforjudicialassistanceincriminalmatters,theforeignaffairsliaisonauthorityshallexa

16、minethewrittenrequestandtheattachedmaterialsinatimelymanner.Itshallexamine:(1) whetherthewrittenrequestindicatestheitemsthatshallbespecifiedunderthe1.awofthePeoplesRepublicofChinaonInternationalJudicialAssistanceinCriminalMatters;(2) whethertherequestisfiledinaccordancewiththetreatyonjudicialassista

17、nceincriminalmattersortheprincipleofreciprocity,amongothers;andiftherequestisfiledundertheprincipleofreciprocity,whetherthewrittenrequestisaccompaniedbyaspecificandexplicitcommitmentofreciprocityfiledbyanappropriateentityintherequestingcountry;书及所附材料进行审查。审查事项包括：（一）请求书是否载明中华人民共和国国际刑事司法协助法规定应当载明的事项；（二

18、）请求是否依据刑事司法协助条约或者互惠原则等提出；依据互惠原则提出请求的，请求书是否附有由清求国适格主体作出的具体明确的互惠承诺；（三）请求书及所附材料是否附有中华人民共和国国际刑事司法协助法或者条约规定的译文；(3) whetherthewrittenrequestandtheattachedmaterialsareaccompaniedbythetranslationthereofrequiredinthe1.awofthePeoplesRepublicofChinaonInternationalJudicialAssistanceinCriminalMattersoratreaty;an

19、d(4)otheritemsthatneedtobeexamined.（四）其他需要审查的事项。前款第二项所指的互惠承诺，应当由请求国外交代表机构或者负责国际司法合作的中央层级机关以书面形式作出，明确承诺对中华人民共和国今后提出的类似请求将提供同等协助，并不得额外增加条件或者进行限制。对外联系机关收到主管机关拟向外国提出的刑事司法协Thecommitmentofreciprocityasmentionedinsubparagraph(2)oftheprecedingparagraphshallbemadeinwritingbytherequestingcountrysdiplomaticmis

20、sionorthecentral-levelorganinchargeofinternationaljudicialcooperation,andshallexpresslyundertaketoprovideequalassistancetoanysimilarrequestfiledbythePeoplesRepublicofChinainthefuture,withoutimposingadditionalconditionsorrestrictions.Afterreceivingarequestforjudicialassistanceincriminalmatterstobesub

21、mittedbytheappropriateauthoritytoaforeigncountry,theforeignaffairs助请求后，参照本条第一款规定对请求书及所附材料进行形式审查后及时对外提出。liaisonauthorityshallpromptlyfiletherequestwiththeforeigncountryafterconductingaformalexaminationofthewrittenrequestandtheattachedmaterialswithreferencetotheprovisionsofparagraph1ofthisarticle.笫三条中

22、华人民共和国国际刑事司法协助法笫二十二条笫三款所称中华人民共和国不负有协助送达的义务，是指对于要求中华人民共和国公民接受讯问或者作为被告人出庭的传票，主管机关有权决定是否协助送达。Article3uThePeoplesRepublicofChinaisnotobligedtoassistintheserviceofprocessasmentionedinparagraph3ofArticle22ofthe1.awofthePeoplesRepublicofChinaonInternationalJudicialAssistanceinCriminalMattersmeansthattheapp

23、ropriateauthorityhastherighttodecidewhethertoassistintheserviceofasummonsrequiringacitizenofthePeoplesRepublicofChinatoaccepttheinterrogationorappearincourtasthedefendant.第四条对外联系机关经审查认为外国刑事司法协助请求书形式和内容符合要求的，应当根据相关法律规定的职责分工，统合考虑请求事项性质、案件所处诉讼阶段等因素确定主管机关：Article4Wheretheforeignaffairsliaisonauthorityde

24、emsuponexaminationthattheformandcontentoftherequestforjudicialassistanceincriminalmatterssatisfytherequirements,itshalldeterminetheappropriateauthorityaccordingtothedivisionofdutiesprescribedbytherelevantlawsandbytakingintocomprehensiveconsiderationthenatureoftherequest,thestageofproceedingsofthecas

25、e,andotherfactors:（一）外国请求协助送达文书、调查取证、安排证人作证或者协助调查，案件尚未进入审判阶段的，转交调查,侦查或者检察机关办理；案件已进入审判阶段的，转交审判机关办理；(1) Ifaforeigncountryrequestsassistanceintheserviceofdocuments,investigationandevidencecollection,arrangingforawitnesstotestifyorassistintheinvestigationbutthecasehasnotenteredthetrialstage,therequestsh

26、allbetransferredtoaninvestigation,criminalinvestigation,orprocuratorialorganforhandling;andifthecasehasenteredthetrialstage,therequestshallbetransferredtothejudicialauthorityforhandling.（二）外国请求协助查封、扣押、冻结涉案财物或者没(2) Ifaforeigncountryrequestsassistanceinplacingunderseal,impounding,orfreezingtheproperty

27、involvedinthecaseorconfiscatingor收、返还违法所得及其他涉案财物的，依照本规定第十六条、第十七条，转交相关主管机关办理；（三）案件较为复杂、请求事项存在特殊情形或者涉及多个主管机关，需要明确转交的主管机关的，对外联系机关可以与相关主管机关协商确定主管机关。returningillegalincomeandotherpropertyinvolvedinthecase,therequestshallbetransferredtotheappropriateauthorityforhandlinginaccordancewithArticles16and17ofthe

28、seProvisions.(3) Ifthecaseiscomplicated,therequesthasspecialcircumstancesorinvolvesmultipleappropriateauthorities,anditisnecessarytospecifytheappropriateauthoritytowhichthecaseshallbetransferred,theforeignaffairsliaisonauthoritymayconsultwiththerelevantappropriateauthoritiestodeterminetheappropriate

29、authority.第五条对外联系机关审查认为外国请求书或者所附材料的形式和内容存在以下情形之一的，可以将请求书退回并书面说明理由，同时要求请求国重新提出请求：Article5Wheretheforeignaffairsliaisonauthoritydeemsuponexaminationthattheformandcontentofthewrittenrequestoftheforeigncountryortheattachedmaterialsfallunderanyofthefollowingcircumstances,itmayreturnthewrittenrequestandex

30、plainthereasonsinwriting,andatthesametime,requiretherequestingcountrytofileanewrequest:（一）请求书存在重大表述错误、影响请求执行的；(1) Thereisanymajormisstatementinthewrittenrequestthataffectstheexecutionoftherequest.（二）请求书未经适当签署或者盖章的；(2) Thewrittenrequestisnotproperlysignedorsealed.（三）请求提出主体和请求对象不符合中华人民共和国法律或者条约规定的；(3)

31、 ThesubjectorobjectoftherequestdoesnotcomplywiththeprovisionsofanylawortreatyofthePeoplesRepublicofChina.（四）请求书存在其他严重影响请求执行的情形。(4) Thewrittenrequestfallsunderanyothercircumstancethatseriouslyaffectstheexecutionoftherequest.Iftheforeignaffairsliaisonauthoritydeemsupon对外联系机关审查认为请求书或者所附材料的形式和内容存在以下情形之一

32、的，可以要求请求国补充材料：examinationthattheformandcontentofthewrittenrequestortheattachedmaterialsfallunderanyofthefollowingcircumstances,itmayrequiretherequestingcountrytosupplementthematerials:(一)请求书或者所附材料关于案件事实或者请求事项的表述不充分、不清晰，可能影响请求执行的：(1) Thewrittenrequestoritsattachedmaterialsdonotadequatelyorclearlydesc

33、ribethefactsofthecaseortherequest,whichmayaffecttheexecutionoftherequest.(二)请求书或者所附材料未附有中华人民共和国法律或者条约规定的译文或者译文不准确，无法确定请求内容的；(2) ThewrittenrequestoritsattachedmaterialsarenotaccompaniedbythetranslationthereofasrequiredbyanylawortreatyofthePeoplesRepublicofChina,orthetranslationisinaccuratesotheconten

34、toftherequestcannotbedetermined.(三)其他需要补充材料的情形。(3) Othercircumstanceswheresupplementarymaterialsarerequired.主管机关审查认为应当全部或者部分拒绝协助，或者存在其他形式或内容不符合要求情形的，应当书面说明理由，通过对外联系机关回复请求国。Iftheappropriateauthoritydeemsuponexaminationthatassistanceshallberefusedinwholeorinpart,orthereisanyothercircumstanceunderwhich

35、theformorcontentoftherequestfailstosatisfytherequirements,itshallstatethereasonsinwritingandgiveareplytotherequestingcountrythroughtheforeignaffairsliaisonauthority.第六条外国刑事司法协助请求存在以下情形之一的，对外联系机关、主管机关和办案机关可以根据案件情况和工作需要优先及理：Article6Whereaforeigncountrysrequestforjudicialassistanceincriminalmattersfall

36、sunderanyofthefollowingcircumstances,theforeignaffairsliaisonauthority,theappropriateauthority,andthecasehandlingauthoritymaygiveprioritytohandlingtherequestaccordingtothecircumstancesofthecaseandworkneeds:(一)需要紧急查封、扣押、冻结涉案财物或者没收(1)Itisnecessarytourgentlyplaceunderseal,impound,orfreezepropertyinvolv

37、edinacaseor违法所得及其他涉案财物的：(2)Itisnecessarytohandletherequestbasedonthetimelimitforinvestigation,investigation,prosecution,ortrial.urgently（二）基于调查、侦查、起criminal诉或者审理期限限制，确有必要紧急处理的；confiscateillegalincomeandotherpropertyinvolvedinacase.（三）涉及的案件具有重大影响或者其他特殊情形的。第七条对外联系机关应当在收到外国刑事司法协助请求或者主管机关执行结果之日起45日内处理完毕

38、：按照本规定第六条优先处理的，一般应当在收到请求或者执行结果之日起30日内处理完毕；需要采取紧急冻结等措施的，应当在收到请求或者执行结果之日起15日内处理完毕。主管机关应当在收到对外联系机关转交的外国刑事司法协助请求或者办案机关执行结果之日起45日内处理完毕：按照本规定第六条优先处理的，一般应当在收到请求或者执行结果之日起30日内处理完毕；需要采取紧急冻结等措施的，应当在收到请求或者执行结果之日起15日内处理完毕。办案机关应当在收到主管机(3)Thecaseinvolvedhasasignificantimpactorfallsunderanyotherspecialcircumstances

39、.Article7Theforeignaffairsliaisonauthorityshallcompletethehandlingwithin45daysofreceivingtheforeigncountrysrequestforjudicialassistanceincriminalmattersortheexecutionresultoftheappropriateauthority.ThecasethatshallbehandledwithpriorityinaccordancewithArticle6oftheseProvisionsshallgenerallybehandledw

40、ithin30daysfromthedateofreceiptoftherequestorexecutionresult.Ifemergencyfreezingandothermeasuresneedtobetaken,thehandlingshallbecompletedwithin15daysfromthedateofreceiptoftherequestorexecutionresult.Theappropriateauthorityshallcompletethehandlingwithin45daysofreceivingtheforeigncountrysrequestforjud

41、icialassistanceincriminalmatterstransferredbytheforeignaffairsliaisonauthorityortheexecutionresultofthecasehandlingauthority.TherequestthatshallbehandledwithpriorityinaccordancewithArticle6oftheseProvisionsshallgenerallybehandledwithin30daysfromthedateofreceiptoftherequestorexecutionresult.Ifemergen

42、cyfreezingandothermeasuresneedtobetaken,thehandlingshallbecompletedwithin15daysfromthedateofreceiptoftherequestorexecutionresult.Thecasehandlingauthorityshall,within90daysof关交办的外国刑事司法协助请求之日起90日内提出处理意见或者执行完毕；按照本规定第六条优先处理的，一股应当在收到请求之日起30日内提出处理意见或者执行完毕；需要采取紧急冻结等措施的，应当在收到请求之日起15日内提出处理意见或者执行完毕。receivingt

44、in30daysfromthedateofreceiptoftherequest.Ifemergencyfreezingorothermeasuresneedtobetaken,thehandlingopinionshallbeprovidedortheexecutionshallbecompletedwithin15daysfromthedateofreceiptoftherequest.办案机关办理具有跨国因素的刑事案件需要外国提供司法协助的，应当及时起草刑事司法协助请求书并附相关材料报所属主管机关审核。主管机关和对外联系机关应当及时审查处理办案机关向外国提出的刑事司法协助请求。Ifaca

45、sehandlingauthorityneedstorequestjudicialassistancefromaforeigncountrywhenhandlingacriminalcasewithtransnationalfactors,itshalldraftawrittenrequestforjudicialassistanceincriminalmattersinatimelymannerandsubmitit,togetherwiththerelevantmaterials,totheappropriateauthorityforreview.Theappropriateauthor

46、ityandtheforeignaffairsliaisonauthorityshallpromptlyexamineandhandletherequestforjudicialassistanceincriminalmatterssubmittedbythecasehandlingauthoritytotheforeigncountry.案件重大复杂需要协调处理的，可以不受本条规定的时限限制，但对外联系机关、主管机关、办案机关相互沟通时应当作出相应说明。Ifacaseismajorandcomplicatedandrequirescoordinatedhandling,itisnotsubj

47、ecttothetimelimitspecifiedinthisarticle,buttheforeignaffairsliaisonauthority,theappropriateauthority,andthecasehandlingauthorityshallmakecorrespondingexplanationswhencommunicatingwitheachother.第八条对外联系机关应当加强与外国有关机关沟通联系，推动外国提高执行中华人民共和国刑事司法协助请求的效率和质量。Article8Aforeignaffairsliaisonauthorityshallstrength

48、encommunicationandcontactwiththerelevantauthoritiesofforeigncountriesandurgeforeigncountriestoimprovetheefficiencyandqualityoftheirimplementationoftherequestsofthePeoplesRepublicofChinaforjudicialassistanceincriminalmatters.对外联系机关和主管机关支持、指导办案机关对外提出刑事司法协助请求。Theforeignaffairsliaisonauthorityandappropriateauthoritiesshallsupportandguidethecasehandlingauthorityinfilingrequestsforjudicialassistanceincriminalmatters.对外联系机关应当定期统计国际刑事司法协助案件办理情况，及时向主管机关通报。笫九条主管机关应当对办案机关应外国刑事司法协助请求调取的证据或者其他信息严格审核把关，确保交由对外联系机关向外国提供的证据或者其他信息在内容和形式上符合相关法律规定。Theforeignaff
