4、第一条为了健全国务 院的组织和工作制度，保障 和规范国务院行使职权，根 据宪法，制定本法。第二条中华人民共和 国国务院，即中央人民政 府，是最高国家权力机关的 执行机关，是最高国家行政 机关。第三条国务院坚持中 国共产党的领导，坚持以马 克思列宁主义、毛泽东思 想、邓小平理论、“三个代 表”重要思想、科学发展 观、习近平新时代中国特色 社会主义思想为指导，坚决 维护党中央权威和集中统一 领导，坚决贯彻落实党中央 决策部署，贯彻新发展理 念，坚持依法行政，依照宪 法和法律规定，全面正确履 行政府职能。OrganicLawoftheStateCouncilofthePeoplesRepublico

6、temoftheStateCouncil,andsafeguardingandregulatingtheStateCouncilsexerciseoffunctionsandpowers.Article2TheStateCouncilofthePeoplesRepublicofChina,thatis,theCentralPeoplesGovernment,istheexecutiveorganofthehighestorganofstatepowerandthehigheststateadministrativeorgan.Article3TheStateCouncilshalladhere

7、totheleadershipoftheCommunistPartyofChina,adheretotheguidanceofMarxism-Leninism,MaoZedongThought,DengXiaopingTheory,theimportantthoughtofThreeRepresents,theScientificOutlookonDevelopment,andXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,resolutelyupholdtheauthorityandcentralizedandu

8、nifiedleadershipoftheCPCCentralCommittee,resolutelyimplementthedecisionsandarrangementsmadebytheCPCCentralCommittee,carryoutnewdevelopmentphilosophy,adheretolaw-basedadministration,andfullyandcorrectlyperformgovernmentfunctionsinaccordancewiththeConstitutionandlaws.TheStateCouncilshalladheretoapeopl

9、ecenteredapproachandservethepeoplewholeheartedly,adheretoanddevelopwholeprocesspeoplesdemocracy,alwaysmaintainclosecontactwiththepeople,listentotheopinionsandrecommendationsofthepeople,andbuildalawbased,innovative,clean,andservice-orientedgovernmenttothesatisfactionofthepeople.Article4TheStateCounci

10、lshallberesponsibletoandreportworktotheNationalPeople,sCongressor,whentheNationalPeoplesCongressisnotinsession,toitsStandingCommittee.TheStateCouncilshallconscientiouslyacceptsupervisionbytheNationalPeoplesCongressanditsStandingCommittee.Article5TheStateCouncilshallbecomposedofthePremier,Vice-Premie

11、rs5StateCouncilors,ministersofallministries,directorsofallcommissions,GovernorofthePeoplesBankofChina,Auditor-General,andSecretary-General.ThePremiershallassumeoverallresponsibilityfortheworkoftheStateCouncil.ThePremiershallhaveleadershipovertheworkoftheStateCouncil.国务院坚持以人民为中心、 全心全意为人民服务，坚持 和发展全过程人

12、民民主，始 终同人民保持密切联系，倾 听人民的意见和建议，建设 人民满意的法治政府、创新 政府、廉洁政府和服务型政 府。第四条国务院对全国 人民代表大会负责并报告工 作；在全国人民代表大会闭 会期间，对全国人民代表大 会常务委员会负责并报告工 作。国务院应当自觉接受全国人 民代表大会及其常务委员会 的监督。第五条国务院由总 理、副总理、国务委员、各 部部长、各委员会主任、中 国人民银行行长、审计长、 秘书长组成。国务院实行总理负责制。总 理领导国务院的工作。副总理、国务委员协助总理 工作，按照分工负责分管领 域工作；受总理委托，负责TheVice-PremiersandStateCouncil

13、orsshallassistthePremierinhisorherwork,andberesponsiblefortheirrespectivework;beresponsiblefortheworkinotheraspectsorspecialtasksasdelegatedbythePremier;andaccordingtouniformarrangements,carryoutforeignaffairsactivitiesonbehalfoftheStateCouncil.Article6TheStateCouncilshallexercisethefunctionsandpowe

14、rsprescribedintheConstitutionandrelevantlaws.Article7TheStateCouncilshallimplementthesystemofplenaryandexecutivemeetingsoftheStateCouncil.TheplenarymeetingsoftheStateCouncilshallbecomposedofallmembersoftheStateCouncil.TheexecutivemeetingsoftheStateCouncilshallbecomposedofthePremier,VicePremiers,Stat

15、eCouncilors,andSecretary-General.ThePremiershallconveneandpresideovertheplenaryandexecutivemeetingsoftheStateCouncil.MajorissuesintheworkoftheStateCouncilmustbediscussedanddecidedatanexecutiveorplenarymeetingoftheStateCouncil.Article8ThemaintasksofplenarymeetingsoftheStateCouncilaretodiscussanddecid

16、eonmajorissuesintheworkoftheStateCouncil,suchasreportsontheworkofthegovernmentandnationaleconomicandsocialdevelopmentplans,andmakearrangementsontheimportantworkoftheStateCouncil.ThemaintasksofexecutivemeetingsoftheStateCouncilaretodiscussdraftlaws,deliberateondraftadministrativeregulations,anddiscus

17、s,decideon,andnotifyimportantmattersintheworkoftheStateCouncil.其他方面的工作或者专项任 务；根据统一安排，代表国 务院进行外事活动。第六条国务院行使宪 法和有关法律规定的职权。第七条 国务院实行国 务院全体会议和国务院常务 会议制度。国务院全体会议 由国务院全体成员组成。国 务院常务会议由总理、副总 理、国务委员、秘书长组 成。总理召集和主持国务院 全体会议和国务院常务会 议。国务院工作中的重大问 题，必须经国务院常务会议 或者国务院全体会议讨论决 定。第八条国务院全体会 议的主要任务是讨论决定政 府工作报告、国民经济和社 会发展

18、规划等国务院工作中 的重大事项，部署国务院的 重要工作。国务院常务会议的主要任务 是讨论法律草案、审议行政 法规草案，讨论、决定、通 报国务院工作中的重要事 项。国务院全体会议和国务院常ThemattersdiscussedanddecidedattheplenaryandexecutivemeetingsoftheStateCouncilshallbepublishedinatimelymanner,exceptforthosethatshallbekeptconfidentialinaccordancewiththelaw.TheStateCouncilshallconvenethePre

19、miersexecutivemeetingsandspecialmeetingsoftheStateCouncilasneeded.Article9ThePremiershallsigntheadministrativeregulations,decisions,andordersissuedbytheStateCouncil,theproposalssubmittedtotheNationalPeople,sCongressoritsStandingCommittee,andtheappointmentorremovalofpersonnel.Article10TheSecretary-Ge

20、neraloftheStateCouncilshall,undertheleadershipofthePremier,beresponsibleforhandlingthedailyworkoftheStateCouncil.TheStateCouncilshallhaveseveralDeputySecretaries-General,whoshallassisttheSecretary-Generalinhisorherwork.TheStateCouncilshallsetupageneraloffice,whichshallbeundertheleadershipoftheSecret

21、ary-General.务会议讨论决定的事项，除 依法需要保密的外，应当及 时公布。国务院根据需要召开总理办 公会议和国务院专题会议。第九条国务院发布的 行政法规、决定、命令，向 全国人民代表大会或者全国 人民代表大会常务委员会提 出的议案，任免人员，由总 理签署。第十条国务院秘书长 在总理领导下，负责处理国 务院的日常工作。国务院设副秘书长若干人, 协助秘书长工作。国务院设立办公厅，由秘书 长领导。第十一条国务院组成 部门的设立、撤销或者合 并，经总理提出，由全国人 民代表大会决定；在全国人 民代表大会闭会期间，由全 国人民代表大会常务委员会 决定。国务院组成部门确定 或者调整后，由全国人民

22、代Article11Theestablishment,dissolution,orconsolidationofcomponentsoftheStateCouncilshallbeproposedbythePremieranddecidedbytheNationalPeoplesCongressor,whentheCongressisnotinsession,byitsStandingCommittee.AfterthedeterminationoradjustmentofcomponentsoftheStateCouncil,itshallbeannouncedbytheNationalPe

23、ople,sCongressoritsStandingCommittee.第十二条国务院组成 部门设部长（主任、行长、 审计长）一人，副部长（副 主任、副行长、副审计长） 二至四人；委员会可以设委 员五至十人。国务院组成部门实行部长 （主任、行长、审计长）负 责制。部长（主任、行长、 审计长）领导本部门的工 作，召集和主持部务（委 务、行务、署务）会议，讨 论决定本部门工作的重大问 题；签署上报国务院的重要 请示、报告和发布的命令、 指示。副部长（副主任、副 行长、副审计长）协助部长 （主任、行长、审计长）工 作。国务院副秘书长、各部副部 长、各委员会副主任、中国 人民银行副行长、副审计长 由

24、国务院任免。第十三条国务院可以 根据工作需要和优化协同高 效精简的原则，按照规定程 序设立若干直属机构主管各 项专门业务，设立若干办事 机构协助总理办理专门事表大会或者全国人民代表大会常务委员会公布。Article12EachcomponentoftheStateCouncilshallhaveoneminister(director,governor,orauditor-general)andtwotofourviceministers(deputydirectors,deputygovernors,ordeputyauditors-general).Thecommitteemayhavef

25、ivetotenmembers.Theminister(director,governor,orauditor-general)shallassumeoverallresponsibilityfortheworkofthecomponentoftheStateCouncil.Theminister(director,governor,orauditor-general)shallleadtheworkofthecomponent,conveneandpresideoverexecutivemeetingsoftheministry(commission,bank,oroffice)todisc

26、ussanddecideonmajorissuesinthecomponentswork,andsignimportantrequestsforinstructionsandreportstobesubmittedtotheStateCouncilandsignissuedordersandinstructions.Theviceministers(deputydirectors,deputygovernors,ordeputyauditors-general)shallassisttheminister(director,governor,orauditor-general)inhisorh

27、erwork.TheDeputySecretary-GeneraloftheStateCouncil,viceministersofallministries,deputydirectorsofallcommissions,DeputyGovernorofthePeoplesBankofChina,andDeputyAuditor-GeneralshallbeappointedorremovedbytheStateCouncil.Article13TheStateCouncilmay,accordingtoworkneedsandtheprinciplesofoptimization,coor

28、dination,efficiency,andsimplification,setupseveralinstitutionsdirectlyunderitaccordingtotheprescribedprocedurestotakechargeofvariousspecialworkandsetupseveraladministrativeofficestoassistthePremierinhandlingspecial项。每个机构设负责人二至 五人，由国务院任免。matters.Eachinstitutionshallhavetwotofivepersonsincharge,whosha

30、asuresintheirwork,andtheStateCouncilshallmakedecisionsonsuchmatters.Theappropriatedepartmentsmay,inaccordancewithlawsandtheadministrativeregulations,decisions,andordersoftheStateCouncil,issueordersandinstructionswithintheirrespectivepower.国务院组成部门和具有行政 管理职能的直属机构以及法 律规定的机构，可以根据法 律和国务院的行政法规、决 定、命令，在本部门

31、的权限 范围内，制定规章。ThecomponentsoftheStateCouncil,institutionswithadministrativefunctionsdirectlyundertheStateCouncil,andinstitutionsprescribedbylawsmay,inaccordancewithlawsandtheadministrativeregulations,decisions,andordersoftheStateCouncil,developruleswithintheirrespectivepower.第十五条国务院统一 领导全国地方各级国家行政 机关
