年10月1日起施行。主任：郑栅洁2023年7月28日TheMeasuresfortheSupervisionandAdministrationofGrainQualityandSafety,asdeliberatedandadoptedatthe3rdexecutivemeetingoftheMinistryofLandandResourcesonJuly11,2023jareherebyissuedandshallcomeintoforceonOctober1,2023.Director:ZhengShanjieJuly28,2023MeasuresfortheSupervisionandAdministrationofGrainQualityandSafetyChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeRegulationontheAdministrationofGrainCirculationandotherapplicablelawsandregulationsforthepurposesofprotectingtheenthusiasmofgrainproducers,maintainingthelawfulrightsandinterestsofgraintradersandconsumers,strengtheningthesupervisionandadministrationofqualityandsafetyinthefieldofgraincirculation,andguaranteeinggrainqualityandsafetythroughoutthecountry.Article2TheseMeasuresshallapplytothesupervisionandadministrationofgrainqualityandsafetyinthepurchase,storage,andtransportofgrainandtheprocessingandsaleofpolicy-orientedgrain.Thespecialrequirementsfortheadministrationofqualityandsafetyofgovernments*grainreservesshallbegovernedbytherelevantprovisionsdevelopedbythenationalfoodandstrategicreservesadministrativedepartment.粮食质量安全监管办法第一章总则第一条 为保护粮食生产者 的积极性，维护粮食经营者和消 费者的合法权益，加强粮食流通 领域质量安全监督管理，保障国 家粮食质量安全，根据粮食流 通管理条例等法律法规，制定 本办法。第二条粮食收购、储存、 运输和政策性粮食购销活动的质 量安全监管工作，适用本办法。政府储备粮食质量安全管理的特 殊要求按国家粮食和储备行政管 理部门制定的相关规定执行。第三条县级以上粮食和储 备行政管理部门在本级人民政府 的统一组织领导下，负责本行政 区域粮食收购、储存、运输和政 策性粮食购销活动中粮食质量安 全的监督管理工作。Article3Afoodandstrategicreservesadministrationatorabovethecountylevelshall,undertheunifiedorganizationandleadershipofthepeople,sgovernmentatthesamelevel,beresponsibleforthesupervisionandadministrationofgrainqualityandsafetyinthepurchase,storage,andtransportofgrainandtheprocessingandsaleofpolicy-orientedgrainwithinitsadministrativeregion.AninstitutiondirectlyundertheNationalFoodandStrategicReservesAdministrationshallberesponsibleforregulatingtheadministrationofthequalityandsafetyofthecentralgovernment'sstrategicreserveswithinitsjurisdiction.Article4Graintradersshallassumetheprimaryresponsibilityforgrainqualityandsafety.Thoseengagedinthetradeofgrainshallstrictlyimplementrelevantlaws,regulations,policies,andstandards,strictlycomplywiththegrainqualityandsafetymanagementsystem,specifytheresponsibilityforqualityandsafetymanagement,conscientiouslyimplementtheanti-foodwaste,foodconservation,andotherrelevantprovisionsandrequirements,andstrictlyprohibitsuchconductasdeducingexcessivebasicsedimentandwater(BSW),downgradinglevelsandprices,sellingoldgrainasfreshgrain,adulterating,andsellingdefectivegrainasgrainofgoodquality.Article5TheStateshallencouragetheadoptionandimplementationofscientificallyadvancedmethods,standards,andapplicabletechnologiesforqualityandsafetymanagementandinspectiontocontinuouslyimprovethelevelofgrainqualityandsafetymanagement.Afoodandstrategicreservesadministrationatorabovethecountylevelshallestablishandimproveitsgrainqualityandsafetydatabase;andproviderelevantpersonnelwithtrainingonrelevantlaws,regulations,policies,standards,andSk川Sregularly.国家粮食和物资储备局垂直管理 机构负责监管辖区内中央政府储 备质量安全管理情况。第四条粮食经营者对粮食 质量安全承担主体责任。从事粮 食经营活动，应当严格执行有关 法律、法规、政策及标准，严格 遵守粮食质量安全管理制度，明 确质量安全管理责任，认真落实 反食品浪费、粮食节约等有关规 定和要求，严禁多扣杂、压级压 价、以陈顶新、掺杂使假、以次 充好等行为。第五条国家鼓励采用并推 行科学先进的质量安全管理和检 验方法、标准和适用技术，不断 提高粮食质量安全管理水平。县 级以上粮食和储备行政管理部门 应当建立并完善粮食质量安全数 据库；定期对相关人员进行有关 法律、法规、政策、标准和技能 等培训。第六条开展粮食质量安全Article6Thenecessaryandreasonableexpensesrequiredforriskmonitoring,inspection,andotherinspectionactivitiesrelatingtograinqualityandsafetyshallbeincludedinthedepartmentalbudgetatthesamelevelinaccordancewiththeapplicableprovisions.风险监测、检验等检查活动所需 必要合理的费用，按照有关规定 列入本级部门预算。粮食质量安全风险监测Chapter II GrainQualityandSafetyRisk第一音Monitoring用一早Article7Afoodandstrategicreservesadministrationatorabovetheprovinciallevelshallestablishandimproveitsqualityandsafetyriskmonitoringsystemforthepurchaseandstorageofgrain,includingthequalityandsafetymonitoringofpurchasedgrain,thequalityandsafetymonitoringofgraininstock,thequalityandsafetymonitoringofemergencygrain,andthequalityandsafetymonitoringofotherspecialgrain.Alocalfoodandstrategicreservesadministrationatorabovethecountylevelshall,inaccordancewiththeprovisionsontheadministrationofgrainqualityandsafetyriskmonitoringandbasedonthespecificcircumstanceswithinitsadministrativeregion,organizeandcarryoutfoodqualityandsafetyriskmonitoringaccordingtoitsduties.第七条省级以上粮食和储 备行政管理部门应当建立健全粮 食收购和储存环节质量安全风险 监测制度，包括收购粮食质量安 全监测、库存粮食质量安全监 测、应急粮食质量安全监测和其 他专项粮食质量安全监测。县级以上地方粮食和储备行政管 理部门应当按照国家粮食质量安 全风险监测管理规定，结合本行 政区域的具体情况，依职责组织 开展粮食质量安全风险监测工 作。县级以上地方粮食和储备行政管 理部门获知粮食质量安全风险信 息后，应当立即组织开展核查， 视情况及时调整粮食质量安全风 险监测计划，依职责采取风险防 控措施，降低粮食质量安全风险 和损失。Alocalfoodandstrategicreservesadministrationatorabovethecountylevelshall,afterobtainingtheinformationongrainqualityandsafetyrisks,immediatelyorganizeaverification,promptlyadjustitsgrainqualityandsafetyriskmonitoringplanasappropriate,andtakeriskpreventionandcontrolmeasuresaccordingtoitsdutiestominimizerisksandlossesrelatedtograinqualityandsafety.Article8Inriskmonitoring,existingresourcesandresultsshallbefullyutilized,andthemonitoringmechanismwhicheachhaveitsownfocus,interactbetweendifferentlevels,areeffectivelyconnected,coordinateeffortsandshareresultsshallbeestablished.Article9Afoodandstrategicreservesadministrationatorabovethecountylevelshallstrengthentheinformationmanagementofthewholeprocessofmonitoringgrainqualityandsafetyrisksandsoforth,andmakeoverallplansfortheuseofrelevantdataandinformationresources.Article10Aprovincialfoodandstrategicreservesadministrationshallpromptlyreporttothepeople,sgovernmentsatthesameleveltheresultsofgrainqualityandsafetyriskmonitoringandinformationonthehandlingoftheproblemsfoundwithinitsadministrativeregion,orshallcirculateanoticetotheofficesofthefoodsafetycommissionsatthesamelevelandtherelevantdepartmentsandentities,withacopythereofsenttothenationalfoodandstrategicreservesadministrativedepartment.第八条开展风险监测工作 应当充分利用现有资源和成果， 建立各有侧重、上下联动、有效 衔接、协同配合、结果共享的监 测机制。第九条县级以上粮食和储 备行政管理部门应当强化粮食质 量安全风险监测等全过程信息化 管理，统筹利用有关数据和信息 资源。第十条省级粮食和储备行 政管理部门应当及时将本行政区 域内粮食质量安全风险监测结果 以及对发现问题的处理情况报告 本级人民政府，通报同级食品安 全委员会办公室及相关部门和单 位，抄送国家粮食和储备行政管 理部门。第十一条县级以上地方粮 食和储备行政管理部门应当按照 本级人民政府加强粮食污染监 控、建立健全被污染粮食处置长 效机制等要求，依职责开展有关 工作。发现区域性粮食污染情况 或者在收购等环节发现有关线索 的，应当按照地方人民政府或者 有关部门和单位的规定，依职责 迅速采取处置措施。Article11Alocalfoodandstrategicreservesadministrationatorabovethecountylevelshall,inaccordancewiththerequirementsofthepeople'sgovernmentatthesamelevel,strengthenthemonitoringofcontaminantsingrain,establishandimproveapermanentmechanismforthedisposalofcontaminatedorspoiledgrain,andsoforth,andcarryouttherelevantworkaccordingtoitsduties.Whereanyregionalgraincontaminationisfoundoranyrelevantclueisdiscoveredwhenthegrainispurchased,itshalltakedisposalmeasuresaccordingtoitsdutiesinaccordancewiththeprovisionsofthelocalpeople,sgovernmentortherelevantdepartmentsandentities.Quality and Safety第三章粮食质量安全管理Chapter III GrainManagementArticle12Theuseofwarehousingfacilitiesandequipmentbygrainpurchasersandgrainstorageenterprisesshallcomplywiththerelevantstandardsandtechnicalspecificationsforgrainstorage,aswellastherequirementsoflawsandregulationsonworksafety.第十二条粮食收购者、粮食储存企业使用仓储设施设备应当符合粮食储存有关标准和技术规范以及安全生产法律、法规的要求；Placesforthepurchaseandstorageofgrainshallbekepttidyandcleanatasafedistancefromtoxicandhazardoussitesandotherpollutionsourcesinaccordancewiththeapplicableprovisions.收购、储存场所应当保持整洁，并按规定与有毒有害场所以及其他污染源保持安全距离。Article13Agraintraderpurchasinggrainshallstrictlyimplementnationalgrainqualitystandardsandpolicies,priceaccordingtoquality,inspecttherelevantgrainqualityandsafetyitemsinaccordancewiththeapplicableprovisionsofthestate,andimplementthefollowingprovisions:第十三条粮食经营者收购粮食，应当严格执行国家粮食质量标准和政策，按质论价，按照国家有关规定进行质量安全检验，并执行下列规定：(1)Informinggrainsellersofandpublishingthevarieties,qualitystandards,purchaseprices,andotherrelevantcontentsofthegraintobepurchasedataconspicuouspositionoftheplaceforpurchase（一）告知售粮者或者在收购场所醒目位置公示粮食的品种、质量标准、收购价格等内容；(2)Takingsamplesandconductinginspectionsatthetimeofentryintostorageandtransferbetweenwarehouses,andcontrollingthequalityofgrainatthetimeofentryintostorageinaccordancewiththeprovisionsofrelevant（二）按照有关标准、技术规范和政策规定进行入库和平仓环节杆样、检验，把好入库质量关。发现不符合食品安全国家标准的粮食，应当及时向收购地县级粮 食和储备行政管理等部门报告， 跨省收购的，应当向收购地和粮 食收购企业所在地的县级粮食和 过标准限量或者政策规定的政策 性粮食，应当及时整理达标或者 符合相关要求。水分较高时应当 合理降水、降温，确保安全储 粮。(3)Policy-orientedgrainwithimpurities,moisturecontent,andotherqualityindicatorsexceedingthestandardlimitortheprovisionsofthepoliciesshallbepromptlysortedouttomeetthestandardormeettherelevantrequirements.Whengrainmoisturecontentishigh,themoistureandtemperatureshallbereasonablyreducedtoensuresafegrainstorage.第十四条鼓励对不同产 地、等级和品质的粮食单收、单 储。Article 14 Grainsofdifferentorigins,grades,andqualitiesshallbeencouragedtobepurchasedandstoredseparately.第十五条粮食经营者收购 非食用用途的粮食，应当单收、 单储、单销，采取在收购码单、 包装、库存货位卡上明确标识等 措施，强化全流程闭环管理。Article 15 Agraintraderwhopurchasesgrainfornon-ediblepurposesshallpurchase,store,orsellgrainseparately,andtakemeasuressuchasclearmarkingonpurchaseyardsticks,packaging,andinventoryspacecardstostrengthentheclosed-loopmanagementofthewholeprocess.粮食经营者对粮食进行单收、单储，应当通过单独仓蕨、物理隔断等措施进行，确保符合有关规Agraintraderwhopurchasesorstoresgrainseparatelyshalltakemeasuressuchasseparategranariesandphysicalseparationtoensurecompliancewiththerelevant定。regulations.第十六条粮食经营者储存 粮食应当遵守粮油仓储管理制度 规定和相关标准，规范仓储管理 业务，合理应用粮油储藏技术。 储存过程中发现粮食质量不符合 要求的，应当及时按规定进行处 置。粮食不得与可能对粮食产生 污染的有毒有害物质混存。Article 16 Agraintraderstoringgrainshallcomplywiththeprovisionsofthegrainandoilstoragemanagementrulesandrelevantstandards,standardizestoragemanagementoperations,andrationallyapplygrainandoilstoragetechnologies.Where,duringtheprocessofstorage,itisfoundthatthequalityofsuchgraindoesnotmeettherequirements,thegrainshallbedisposedofpromptlyinaccordancewiththeapplicableprovisions.Nograinshallbemixedwithtoxicorhazardoussubstancesthatmaycausepollutiontothegrain.国家鼓励建设高标准粮仓，推广 使用绿色储粮技术，有效保障储 存安全和粮食品质。Thestateencouragestheconstructionofhigh-standardgrainsilosandpromotestheuseofgreengrainstoragetechnologytoeffectivelyguaranteestoragesafetyandgrainquality.第十七条粮食经营者储存 粮食应当严格执行储粮药剂使用 管理制度和相关标准，不得使用 国家禁止使用的化学药剂或者超 量使用化学药剂。Article 17 Agraintraderstoringgrainmuststrictlyimplementthemanagementrulesandrelevantstandardsfortheuseofpesticidesinthestorageofgrain,andshallnotusethechemicalagentstheuseofwhichorexcessiveuseofwhichisprohibitedbythestate.第十八条粮食销售出库 前，粮食经营者应当严格按照粮 食质量安全标准及有关规定进行 质量安全检验，出具检验检测数 据、结果、报告（以下统称检验 报告），作为出库质量安全依 据。未经质量安全检验的粮食不 得销售出库。Article 18 Beforegrainissoldandtakenoutofstorage,agraintradershall,instrictaccordancewiththegrainqualityandsafetystandardsandrelevantprovisions,inspectgrainqualityandsafety,andissuetheinspectionandtestingdata,results,andreports(hereinaftercollectivelyreferredtoasthe“inspectionreports),asabasisfortheout-of-storagequalityandsafety.Nograinshallbesoldandtakenoutofstoragewithoutanyqualityandsafetyinspection.（一）在正常储存年限内的粮 食，销售出库前粮食储存企业应 当自行检验或者委托粮食质量安 全检验机构进行质量安全检验， 并出具检验报告；（二）超过正常储存年限的粮 食，或者储存期间使用储粮药剂 未满安全间隔期的粮食，以及色 泽、气味异常的粮食，在出库前 应当委托粮食质量安全检验机构 进行质量安全检验，并出具检验 报告。(1) Whenanygrainwithinthenormalstorageperiodissoldandtakenoutofstorage,thegraintradershallindependentlyinspectthegrainandissueaninspectionreportorcommissionagrainqualityandsafetyinspectionbodytoinspectthequalityandsafetyofsuchgrainandissueaninspectionreport.(2) Beforeanygrainbeyondthenormalstorageperiod,usingchemicalagentsduringstoragenotbeyondtheintervalperiodforsafeuse,orwithanycolororodorabnormalityissoldandtakenoutofstorage,agrainqualityandsafetyinspectionbodyshallbecommissionedtoconductaqualityandsafetyinspectionandissueaninspectionreport.销售出库粮食的质量安全状况应 当与检验报告相一致。检验报告 应当随货同行，有效期为自签发 之日起6个月，国家另有规定 的，从其规定。有效期满，应当 重新检验并出具检验报告。Thequalityandsafetyofgrainsoldoutofstorageshallbeconsistentwiththosespecifiedintheinspectionreport.Theinspectionreportshallaccompanythegoodsandbevalidforsixmonthsfromthedateofissuance,exceptasotherwiseprovidedforbythestate.Wheretheperiodofvalidityisexpired,thegrainshallbere-inspectedandanewinspectionreportshallbeissued.粮食质量安全检验机构应当按照 委托方要求的时间和方式完成杆 样、检验并出具检验报告。Agrainqualityandsafetyinspectionbodyshall,accordingtothetimeandmannerrequiredbythecommissioningparty,completethetakingofsamplesandinspectionsandissueaninspectionreport.第十九条粮食收购者、粮 食储存企业不得将直接拌有农 药、混有农药残渣、含有国家禁 止使用的储粮药剂或者超量使用Article19Nograinpurchaserorgrainstorageenterpriseshallsellandtakegrainfromstoragewhichhasbeendirectlymixedwithpesticidesorpesticideresiduesorwhichcontainsthechemicalagentstheuseofwhich化学药剂的粮食作为食用用途销 售出库。定向销售用作非食用用 途的粮食，应当在包装、销售凭 证中明确标识用途。对定向销售 作为非食用用途的政策性粮食的 质量安全管理另有规定的，从其 食可能受到有害物质污染、发生 霉变等情况，或者根据有关政策 规定，省级粮食和储备行政管理 部门应当统一或者分地区设定粮 食收购和出库质量安全必检项 目，并抄送国家粮食和储备行政 管理部门。Article20Accordingtothecircumstancesunderwhichgrainmaybecontaminatedwithharmfulsubstancesormoldy,orinaccordancewiththeprovisionsofrelevantpolicies,aprovincialfood,andstrategicreservesadministrationshallunifyorsub-regionallysetthemandatoryinspectionitemsforthequalityandsafetyofgrainpurchasedandgrainsoldandtakenoutofstorage,withacopythereofsenttothenationalfoodandstrategicreservesadministrativedepartment.第二十一条 运输粮食的运 输工具、容器应当完好，并保持 清洁、干燥、安全卫生。非专用 车（船）应当有必要的铺垫物和 防潮湿等设备，铺垫物、防潮湿 设备等必备物品应当符合国家有 关标准和政策要求。Article 21
