纺织品和服装货物,在执行禁令或数量限制方面,包括一缔约方根据本章规定的程序,对另一缔约方境内的出口商或生产商的货物生产能力进行核查,条件是在进行核查之前,拟进行核直的缔约方的海关管理部门.Article513:WorkingGroupandCustomsSubgroup第513条工作组和海关小组1.ThePartiesherebyestablishaWorkingGrouponRulesofOrigin,comprisingrepresentativesofeachParty,toensure:1.缔约双方特此成立一个由各方代表组成的原产地规则工作组,以确保:a)theeffectiveimplementationandadministrationofArticles303(RestrictiononDrawbackandDutyDeferralPrograms),308(Most-Favored-NationRatesofDutyonCertainGoods)and311,ChapterFour,thisChapter,theMarkingRulesandtheUniformRegulations;anda)有效实施和管理第303条(限制退税和减免税方案)、第308条(某些货物的最惠国税率)和第311条、第四章、本章、标识规则和统一条例;和b)theeffectiveadministrationoftheCustomsrelatedaspectsofChapterThree.b)有效管理第三章中与海关有关的内容。2.TheWorkingGroupshallmeetatleastfourtimeseachyearandontherequestofanyParty.2.工作组每年应至少举行四次会议,并应任何缔约方的要求举行会议。ChapterSix:EnergyandBasicPetrochemicals第六章能源和基础石化产品Article601:Principles第601条:原则1.ThePartiesconfirmtheirfullrespectfortheirConstitutions.1.双方确认充分尊重各自的宪法。2.ThePartiesrecognizethatitisdesirabletostrengthentheimportantrolethattradeinenergyandbasicpetrochemicalgoodsplaysinthefreetradeareaandtoenhancethisrolethroughsustainedandgradualliberalization.2.缔约双方承认,应加强能源和基础石化产品贸易在自由贸易区中的重要作用,并通过持续和逐步的自由化加强这一作用。3.ThePartiesrecognizetheimportanceofhavingviableandinternationallycompetitiveenergyandpetrochemicalsectorstofurthertheirindividualnationalinterests.3.双方认识到,拥有可行的和具有国际竞争力的能源和石化部门对促进各自国家利益的重要性。Article723:TechnicalConsultations第723条:技术咨询1.APartymayrequestconsultationswithanotherPartyonanymattercoveredbythisSection.1.一缔约方可请求与另一缔约方就本节所涵盖的任何事项进行磋商。2.EachPartyshouldusethegoodofficesofrelevantinternationalandNorthAmericanstandardizingorganizations,includingthosereferredtoinArticle713(5),foradviceandassistanceonsanitaryandphytosanitarymatterswithintheirrespectivemandates.2.各缔约方应利用有关国际和北美标准化组织,包括第713条第(5)款提及的组织的斡旋,就其各自职责范围内的卫生和植物检疫问题提供咨询和协助。3.WhereaPartyrequestsconsultationsregardingtheapplicationofthisSectiontoaParty'ssanitaryorphytosanitarymeasure,andsonotifiestheCommittee,theCommitteemayfacilitatetheconsultations,ifitdoesnotconsiderthematteritself,byreferringthematterfornon-bindingtechnicaladviceorrecommendationstoaworkinggroup,includinganadhocworkinggroup,ortoanotherforum.3.如果一缔约方要求就本节对其卫生或植物检疫措施的适用进行磋商并通知委员会,委员会可为磋商提供便利,如果委员会本身不审议该事项,则可将该事项提交一工作组(包括特设工作组)或另一论坛,以寻求不具约束力的技术咨询或建议。Article1020:TechnicalCooperation第1020条技术合作1.ThePartiesshallcooperate,onmutuallyagreedterms,toincreaseunderstandingoftheirrespectivegovernmentprocurementsystems,withaviewtomaximizingaccesstogovernmentprocurementopportunitiesforthesuppliersofallParties.1.缔约各方应在相互商定的条件下开展合作,增进对各自政府采购制度的了解,以期最大限度地为所有缔约各方的供应商提供政府采购机会I)2.EachPartyshallprovidetotheotherPartiesandtothesuppliersofsuchParties,onacostrecoverybasis,informationconcerningtrainingandorientationprogramsregardingitsgovernmentprocurementsystem,andaccessonanon-discriminatorybasistoanyprogramitconducts.2.各缔约方应在收回成本的基础上,向其他缔约方和这些缔约方的供应商提供有关其政府采购制度的培训和指导计划的信息,并在无歧视的基础上提供参加其实施的田可计划的机会。
