MeasuresforthePublicSecurity/AdministrationoftheScrapMetalCollectionIndustry(2023Revision)DocumentNumber：OrderNo.764of(heStateCouncilofthePeople'sRepublicofChinaAreaofLawPublicSecurityAdministrationMaterialsAdministration1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：07-20-2023EffectiveDale：07-20-2023Status:Effective1994-2023AnnotationVersionMeasuresforthePublicSecurityAdministrationoftheScrapMelalCollectionIndustry(AsapprovedbytheStateCouncilonJanuary5,1994,issuedbyOrderNo.16oftheMinistryofPublicSecurityonJanuary25,1994,andrevisedinaccordancewiththeDecisionoftheStaleCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)Article1TheseMeasuresaredevelopedforthepurposeofstrengtheningthepublicsecurityadministrationofthescrapmetalcollectionindustry,protectinglawfulbusinessoperations,andpreventingandcrackingdownonillegalandcriminalactivities.Article2ForthepurposesoftheseMeasures,4tscrapmetalsmeansproductivescrapmetalsandnon-produclivescrapmetals.Thespecificclassificationofproductivescrapmetalsandnon-productivescrapmetalsshallbeprovidedforbytheMinistryofPublicSecurityinconjunctionwiththerelevant废旧金属收购业治安管理办法（1994年1月5日国务院批准1994年1月25日公安部令第16号发布根据2023年7月20日国务院关于修改和废止部分行政法规的决定修订）第一条为了加强对废旧金属收购业的治安管理，保护合法经营，预防和打击违法犯罪活动，制定本办法。第二条本办法所称废旧金属，是指生产性废旧金属和非生产性废旧金属。生产性废旧金属和非生产性废旧金属的具体分类由公安部会同有关部门规定。departments.Article3Productivescrapmetalsshall,inaccordancewiththeapplicableprovisionsissuedbytheStateCouncil,becollectedbyenterpriseshavingtherighttoconductbusinessoperationsintheproductivescrapmetalcollectionindustry.Otherenterprisesandindividualindustrialandcommercialhouseholdscollectingscrapmetalsmayonlycollectnonproductivescrapmetals,andmaynotcollectproductivescrapmetals.Article 4 Anenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsshall,within15daysofobtainingitsbusinesslicense,undergorecordationformalitieswiththepublicsecurityauthorityofthepeople'sgovernmentofthecountyorequivalentwhereitislocated.Ifanyrecordationmatterchanges,theenterpriseorindividualindustrialandcommercialhouseholdcollectingscrapmetalsshall,within15daysofthechange(orwithin15daysofmodificationofindustrialandcommercialregistrationifitisamatterofindustrialandcommercialregistration),undergomodificationformalitieswiththepublicsecurityauthorityofthepeople'sgovernmentofthecountyorequivalent.Thepublicsecurityauthoritiesmay,byonlineandothermeans,facilitatetherecordationofenterprisesandindividualindustrialandcommercialhouseholds.Article 5 Anenterprisecollectingscrapmetalsshallhavea第三条生产性废旧金属，按照国务院有关规定由有权经营生产性废旧金属收购业的企业收购。收购废I日金属的其他企业和个体工商户只能收购非生产性废旧金属，不得收购生产性废旧金属。第四条收购废旧金属的企业和个体工商户，应当在取得营业执照后15日内向所在地县级人民政府公安机关备案。备案事项发生变更的，收购废旧金属的企业和个体工商户应当自变更之日起15日内（属于工商登记事项的自工商登记变更之日起15日内）向县级人民政府公安机关办理变更手续。公安机关可以通过网络等方式，便利企业和个体工商户备案。第五条收购废旧金属的企业应当有固定的经营场fixedbusinesspremise.Anindividualindustrialandcommercialhouseholdcollectingscrapmetalsshallhavealocallyregisteredpermanentresidenceortemporaryresidence.Article 6 Nocollectionstationshallbesetupneararailway,miningarea,oilfield,port,airport,constructionsite,militaryrestrictedzone,ormetalsmeltingandprocessingenterpriseforthecollectionofscrapmetals.Article 7 Anenterprisecollectingscrapmetalsshallcheckthecertificateissuedbytheseller,andtruthfullyregisterthenameoftheseller,thename,address,andidentificationnumberofthehandlingperson,andthenames,quantity,specifications,andconditionsoftheitemsduringthecollectionofproductivescrapmetals.Article 8 Anenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsmaynotcollectthefollowingmetalitems:(1) Guns,ammunition,andexplosives.(2) Highlytoxic,radioactivesubstancesandrelatedcontainers.(3) Specialmeansforrailways,oilfields,powersupply,telecommunication,mining,waterconservancy,surveyingandurbanutilities.(4) Stolenorsuspectedstolenitemsthatarebeingsearchedbyapublicsecurityauthoritythroughanannouncement.所。收购废旧金属的个体工商户应当有所在地常住户口或者暂住户口。第六条在铁路、矿区、油田、港口、机场、施工工地、军事禁区和金属冶炼加工企业附近，不得设点收购废旧金属。第七条收购废旧金属的企业在收购生产性废旧金属时，应当查验出售单位开具的证明，对出售单位的名称和经办人的姓名、住址、身份证号码以及物品的名称、数量、规格、新旧程度等如实进行登记。第八条收购废旧金属的企业和个体工商户不得收购下列金属物品：（一）枪支、弹药和爆炸物品；（二）剧毒、放射性物品及其容器；（三）铁路、油田、供电、电信通讯、矿山、水利、测量和城市公用设施等专用器材；（四）公安机关通报寻查的赃物或者有赃物嫌疑的物品。Article 9 Whereanenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsfindsanysaleofstolenorsuspectedstolenitemsthatarebeingsearchedbyapublicsecurityauthoritythroughanannouncement,itshallimmediatelyfileareportwiththepublicsecurityauthority.Thepublicsecurityauthorityshalldetainthestolenorsuspectedstolenitemsandissueareceipt.Thesuspectedstolenitemsshallbereturnedpromptlyiftheyarefoundnottobestolen;thestolenorsuspectedstolenitemsshallbedisposedofinaccordancewiththeapplicableprovisionsissuedbythestateiftheyarefoundtobestolen.Article 10 Apublicsecurityauthorityshallguideandinspectthepublicsecuritybusinessofenterprisesorindividualindustrialandcommercialhouseholdscollectingscrapmetals.Anenterpriseoranindividualindustrialandcommercialhouseholdcollectingscrapmetalsshallassistpoliceofficersininvestigatingandpunishingoffenders,truthfullyreporttherelevantinformation,andshallnotfailtoreportifitorheknowsthefactsornotharboranoffender.Article 11 Underanyofthefollowingcircumstances,apublicsecurityauthorityshallimposeapenaltyaccordingly:(1) Forthecollectionofproductivescrapmetalswithoutundergoingrecordationformalitiesinviolationofparagraph1ofArticle4oftheseMeasures,thepublicsecurityauthorityshallissueawarningtotheviolator,andordertheviolatorto第九条收购废旧金属的企业和个体工商户发现有出售公安机关通报寻查的赃物或者有赃物嫌疑的物品的，应当立即报告公安机关。公安机关对赃物或者有赃物嫌疑的物品应当予以扣留，并开付收据。有赃物嫌疑的物品经查明不是赃物的，应当及时退还；赃物或者有赃物嫌疑的物品经查明确属赃物的，依照国家有关规定处理。第十条公安机关应当对收购废旧金属的企业和个体工商户进行治安业务指导和检查。收购企业和个体工商户应当协助公安人员查处违法犯罪分子，据实反映情况，不得知情不报或者隐瞒包庇。第H条有下列情形之一的，由公安机关给予相应处罚：（一）违反本办法第四条第一款规定，未履行备案手续收购生产性废旧金属的，予以警告，责令限期改正，逾期拒不改正的，视情节轻重，处以500元以上2000元以下的罚款：未履行备案手续收购非生产性废旧金属的，予以警告或者处以500元以下的罚款;takecorrectiveactionwithinaprescribedtimelimit,andiftheviolatorfailstodoso,shallimposeafineofnotlessthan500yuannormorethan2,(XM)yuanontheviolator,dependingontheseriousnessofthecircumstances;orforthecollectionofnon-productivescrapmetalswithoutundergoingrecordationformalitiesinviolationofparagraph1ofArticle4oftheseMeasures,thepublicsecurityauthorityshallissueawarningtotheviolator,orimposeafineofnotmorethan5(X)yuanontheviolator.（二）违反本办法第四条第二款规定，未向公安机关办理变更手续的，予以警告或者处以200元以下的罚款；(2) Forafailuretoundergomodificationformalitieswiththepublicsecurityauthorityinviolationofparagraph2ofArticle4oftheseMeasures,thepublicsecurityauthorityshallissueawarningtotheviolator,orimposeafineofnotmorethan200yuanontheviolator.（三）违反本办法第六条规定，非法设点收购废旧金属的，予以取缔，没收非法收购的物品及非法所得，可以并处5000元以上10000元以下的罚款；(3) ForthecollectionofscrapmetalsbyillegallysettingupacollectionstationinviolationofArticle6oftheseMeasures,thepublicsecurityauthorityshalleliminatethecollectionstation,confiscatetheitemsillegallycollectedandanyillegalproceeds,andmayimposeafineofnotlessthan5,000yuannormorethan10,000yuanontheviolator.（四）违反本办法第七条规定，收购生产性废旧金属时未如实登记的，视情节轻重，处以2000元以上5000元以下的罚款或者责令停业整顿；（五）违反本办法第八条规定，收购禁止收购的金属物品(4) Forthefalseregistrationduringthecollectionofproductivescrapmetals,inviolationofArticle7oftheseMeasures,thepublicsecurityauthorityshallimposeafineofnotlessthan2,000yuannormorethan5,000yuanontheviolator,orordertheviolatortosuspendbusinessforanoverhaul,dependingontheseriousnessofthecircumstances.(5) ForthecollectionofmetalitemsprohibitedfromcollectioninviolationofArticle8oftheseMeasures,thepublicsecurityauthorityshallimposeafineofnotlessthan2,000yuannormorethan1(),(X)Oyuanontheviolator,orordertheviolatortosuspendbusinessforanoverhaul,dependingontheseriousnessofthecircumstances.Ifanyofthecircumstancesinsubparagraphs，(3),(4),and(5)intheprecedingparagraphconstitutesacrime,theoffendershallbeheldcriminallyliableinaccordancewiththelaw.Article12Againstaspecificadministrativeactiontakenbyapublicsecurityauthority,thepartymayapplytothepublicsecurityauthorityatthenexthigherlevelforconsiderationwithin15daysofknowingthespecificadministrativeaction;oragainstareconsiderationdecision,thepartymayinstituteanactioninapeople'scourtwithin15daysofreceiptofanoticeofthereconsiderationdecision.Article13ApublicsecurityauthorityshallcommendorrewardthoseentitiesandindividualswhohavemaderemarkableachievementsbystrictlyimplementingtheseMeasuresandassistingthepublicsecurityauthorityinseizingoffendersArtiCIC14TheseMeasuresshallcomeintoforceonthedate的，视情节轻重，处以2000元以上100oO元以下的罚款或者责令停业整顿。有前款所列第（一）、（三）、（四）、（五）项情形之一,构成犯罪的，依法追究刑事责任。第十二条当事人对公安机关作出的具体行政行为不服的，可以自得知该具体行政行为之日起15日内向上一级公安机关申请复议；对复议决定不服的，可以自接到复议决定通知之日起15FI内向人民法院提起诉讼。第十三条对严格执行本办法，协助公安机关查获违法犯罪分子，作出显著成绩的单位和个人，由公安机关给予表彰或者奖励。第十四条本办法自发布之日起施行。ofissuance.
