Reasonablyshorteningthenegativelistforforeigninvestmentaccess.Themanagementsystemforpreestablishmentnationaltreatmentplusanegativelistforforeigninvestmentwillbeimproved,allrestrictionsonforeign扎实推进高水平对外开放更大力度吸引和利用外资行动方案外商投资是参与中国式现代化建设、推动中国经济与世界经济共同繁荣发展的重要力量。扎实推进高水平对外开放、更大力度吸引和利用外资,必须坚持以习近平新时代中国特色社会主义思想为指导,完整、准确、全面贯彻新发展理念,更好统筹国内国际两个大局,营造市场化、法治化、国际化一流营商环境,充分发挥我国超大规模市场优势,巩固外资在华发展信心,提升贸易投资合作质量和水平。为贯彻落实党中央、国务院决策部署,现制定如下行动方案。一、扩大市场准入,提高外商投资自由化水平(一)合理缩减外商投资准入负面清单。健全外商投资准入前国民待遇加负面清单管理制度,全面取消制造业领域外资准入限制措施,持续推进电信、医疗等领域扩大开放。investmentinthemanufacturingindustrywillberemovedcomprehensively,andopening-upofthetelecommunications,medicalcareandotherfieldswillbecontinuouslypromoted.(二)开展放宽科技创新领域外商投资准入试点。允许北京、上海、广东等自由贸易试验区选择若干符合条 件的外商投资企业在基因诊断与治疗技术开发和应用等领 域进行扩大开放试点。支持信息服务(限于应用商店)等 领域开放举措在自由贸易试验区更好落地见效。2. Implementingthepilotprogramofrelaxingaccessforforeigninvestmentinthescientificandtechnologicalinnovationfield.Beijing,Shanghai,Guangdongandotherpilotfreetradezonesareallowedtoselectanumberofqualifiedforeign-fundedenterprisestoexpandthepilotprogramofopening-upinthefieldsofgeneticdiagnosisanddevelopmentandapplicationoftreatmenttechnologies.Moreeffectiveimplementationoftheopening-upmeasuresintheinformationservices(limitedtoAppstores)andotherfieldsinpilotfreetradezoneswillbesupported.()扩大银行保险领域外资金融机构准入。在保 障安全、高效和稳定的前提下,支持符合条件的外资机构 依法开展银行卡清算业务。深化商业养老保险、健康保险 等行业开放,支持符合条件的境外专业保险机构在境内投 资设立或参股保险机构。(四)拓展外资金融机构参与国内债券市场业务范 围。优化外资金融机构参与境内资本市场有关程序,进一 步便利外资金融机构参与中国债券市场。支持符合条件的 外资金融机构按规定参与境内债券承销。研究稳妥推动更 多符合条件的外资银行参与国债期货交易试点。3. Expandingaccessofforeign-fundedfinancialinstitutionstothebankingandinsurancefield.Underthepremiseofensuringsecurity,efficiencyandstability,qualifiedforeign-fundedinstitutionswillbesupportedincarryingoutbankcardclearingbusinessinaccordancewiththelaw.Opening-upofcommercialpensioninsurance,healthinsuranceandotherindustrieswillbedeepened,andqualifiedoverseasprofessionalinsuranceinstitutionswillbesupportedinformingorholdingnon-controllingsharesofinsuranceinstitutions.4. Expanding(hebusinessscopeofforeign-fundedfinancialinstitutionstoparticipateinthedomesticbondmarket.Therelevantproceduresforforeign-fundedfinancialinstitutionstoparticipateinthedomesticcapitalmarketwillbeoptimizedtofurtherfacilitatetheirparticipationinChina'sbondmarket.Qualifiedforeign-fundedfinancialinstitutionswillbesupportedinparticipatingindomesticbondunderwritinginaccordancewiththeprovisions.Studywillbeconductedonthepilotprogramtosteadilyurgemorequalifiedforeignbankstoparticipateintradingoftreasurybondfutures.(五)深入实施合格境外有限合伙人境内投资试点。扩大合格境外有限合伙人试点范围,规范合格境外有 限合伙人管理企业及基金在注册资本、股东等方面的要 求,拓宽基金可以投资的范围。完善私募投资基金服务业 务管理办法,鼓励外商投资设立私募基金并依法开展各类 投资活动。5. Furtherimplementingthepilotprogramforqualifiedforeignlimitedpartnerstomakedomesticinvestment.Thescopeofthepilotprogramforqualifiedforeignlimitedpartnerswillbeexpanded,therequirementsforregisteredcapitalandshareholdersofenterprisesandfundsmanagedbyqualifiedforeignlimitedpartnerswillbestandardized,andthescopeofinvestmentsthatfundsmaymakewillbeexpanded.Themeasuresfortheadministrationofprivatelyofferedinvestmentfundssen,icebusinesswillbeimprovedandforeigninvestorswillbeencouragedtosetupprivatefundsandcarryoutvariousinvestmentactivitiesinaccordancewiththelaw.二、加大政策力度,提升对外商投资吸引力11.IntensifyingpolicyeffortstomakeChinamoreattractivetoforeigninvestment(六)扩大鼓励外商投资产业目录和外资项目清单。全国鼓励外商投资产业目录加大对先进制造、高新技 术、节能环保等领域的支持力度,中西部地区外商投资优 势产业目录加大对基础制造、适用技术、民生消费等领域 的支持力度。积极支持集成电路、生物医药、高端装备等 领域外资项目纳入重大和重点外资项目清单,允许享受相 应支持政策。6. ExpandingtheCatalogueofEncouragedIndustriesforForeignInvestmentandthelistofforeign-fundedprojects.Thesupportofthenationalcatalogueofencouragedindustriesforforeigninvestmentinadvancedmanufacturing,newandhightechnology,energyconservationandenvironmentalprotection,andotherfieldswillbeincreased,andthesupportofthecatalogueofadvantageousindustriesforforeigninvestmentinthecentralandwesternregionsinthebasicmanufacturing,applicabletechnologies,people'slivelihoodandconsumption,andotherfieldswillbeincreased.Foreigninvestmentprojectsinthefieldsofintegratedcircuits,biomedicine,andhigh-endequipmentwillbeactivelysupportedinbeingincludedinthelistofmajorandkeyforeigninvestmentprojects,andareallowedtoenjoycorrespondingsupportingpolicies.(七)落实税收支持政策。外商投资企业在中国境内再投资企业所投资的项目,符合鼓励外商投资产业目录 等条件的,可按规定享受进口自用设备免征关税政策。落 实境外投资者投资中国债券市场等金融市场相关税收优惠 政策。7. Implementingtaxsupportpolicies.Projectsinvestedbyenterprisesre-investedbyforeign-fundedenterprisesintheterritoryofChinathatmeettheconditionsoftheCatalogueofEncouragedIndustriesforForeignInvestmentmay,accordingtotheprovisions,enjoythetariffexemptionpolicyforimportedself-useequipment.ThepreferentialtaxpoliciesforforeigninvestorsinvestinginChina'sbondmarketandotherfinancialmarketswillbeimplemented.(八)加大金融支持力度。鼓励金融机构按照市场 化原则为符合条件的外资项目提供优质金融服务和融资支 持。支持符合条件的外商投资企业在境内发行人民币债券 融资并用于境内投资项目。推进实施跨境贸易投资外汇管 理便利化政策,持续提升外商投资企业外汇业务便利度。8. Increasingfinancialsupport.Financialinstitutionswillbeencouragedtoprovidehigh-qualityfinancialSerViCeSandfinancingsupportforqualifiedforeigninvestmentprojectsundermarket-basedprinciples.Qualifiedforeign-fundedenterpriseswillbesupportedinissuingRMBbondsinChinaforfinancinganddomesticinvestmentprojects.Theimplementationofforeignexchangemanagementfacilitationpoliciesforcross-bordertradeandinvestmentwillbepromoted,andtheforeignexchangebusinessfacilitationofforeign-fundedenterpriseswillbecontinuouslyenhanced.(九)强化用能保障。完善能源消耗总量和强度调控,重点控制化石能源消费,落实原料用能和非化石能源 消费不纳入能源消耗总量和强度控制等政策,一视同仁保 障外资项目合理用能需求。加快推动绿证交易和跨省区绿 电交易,更好满足外商投资企业绿电需求。9. Strengtheningguaranteeforenergyuse.Regulationoftotalenergyconsumptionandintensitywillbeimproved,withafocusonthecontroloffossilenergyconsumption.Thepoliciesthatexcluderawmaterialenergyuseandnon-fossilenergyconsumptionfromtotalenergyconsumptionandintensitycontrolwillbeimproved,anditwillbeensuredthattherationalenergyuseneedsofforeign-fundedprojectsareguaranteedonanequalbasis.Greencertificatetradingandcross-provincialgreenelectricitytradingwillbepromotedinanacceleratedmannertomoreeffectivelymeetthegreenelectricityneedsofforeign-fundedenterprises.1().SupportingthecentralandwesternregionsandNortheastChinainundertakingindustrialtransfer.ThecentralandwesternregionsandNortheastChinawillbeencouragedtomaximizetheircomparativeadvantages,anddevelopthepoliciesandmeasuresforreducingmanufacturingenterprises'costsofusingland,energy,andlabor,andlogisticsinlightoflocalcircumstances.KeydevelopmentzoneswillbeplannedandintegratedinthecentralandwesternregionsandNortheastChina,enablingsuchzonestocooperatewiththeeasternregionintransferringindustrieswithforeigninvestmentinapaired-upmanner.Forsuchtransfer,themechanismanddetailedimplementationrulesforprojectpromotion,cadreexchangeandrevenuesharingwillbeestablishedandimproved.III.Optimizingfaircompetitionenvironmentandeffectivelyprovidingservicesforforeign-fundedenterprises11. Reviewingbehaviors,policiesandmeasuresthatviolatefaircompetition.Thediscriminatorybehaviorsagainstforeign-fundedenterprisesingovernmentprocurement,biddingandtendering,qualificationlicensing,standarddevelopment,subsidiesandotherrespectsreportedbybusinessentitieswillbehandledinatimelymanner,andresponsibleentitieswillbenotifiedandbeorderedtoconductrectificationwithinaprescribedtimelimit.Thedevelopmentandissuanceof(十)支持中西部和东北地区承接产业转移。鼓励中西部和东北地区发挥地方比较优势,因地制宜制定降低制造业企业用地、用能、用工、物流等成本的政策措施。在中西部和东北地区规划整合重点开发区,与东部地区结对开展外商投资产业转移合作,建立健全项目推介、干部交流、收益共享的机制和实施细则。三、优化公平竞争环境,做好外商投资企业服务(H-一)清理违反公平竞争的行为和政策措施。及时处理经营主体反映的政府采购、招标投标、资质许可、标准制定、享受补贴等方面对外商投资企业的歧视行为,对责任主体予以通报并限期整改。加快制定出台政府采购本国产品标准,在政府采购活动中对内外资企业生产的符合标准的产品一视同仁、平等对待。全面清理妨碍统一市场和公平竞争的政策措施。standardsforgovernmentprocurementofdomesticproductswillbeaccelerated,andingovernmentprocurementactivities,productsproducedbydomesticandforeign-fundedenterprisesthatmeetthesestandardswillbetreatedasequals.Thepoliciesandmeasuresthatimpedetheunifiedmarketandfaircompetitionwillbecomprehensivelyreviewed.(十二)完善招标投标制度。加快推进修改招标投 标法。组织开展招标投标领域突出问题专项治理,集中纠 治一批经营主体反映比较强烈的问题,破除制约各类所有 制企业平等参与招标投标的不合理限制。制定招标投标领 域公平竞争审查规则,强化公平竞争审查刚性约束,避免 出台排斥限制公平竞争的政策文件。12. Improvingthebiddingandtenderingsystem.TherevisionoftheBiddingLawwillbepromotedinanacceleratedmanner.Specialgovernanceofprominentproblemsinthefieldofbiddingandtenderingwillbeorganizedandcarriedout,problemsthatarestronglyreflectedbyanumberofbusinessentitieswillbecorrectedinacentralizedmanner,andunreasonablerestrictionsthatrestrictenterprisesofallformsofownershipfromparticipatinginbiddingandtenderingonanequalbasiswillberemoved.Therulesforthereviewoffaircompetitioninthefieldsofbiddingandtenderingwillbedeveloped,rigidconstraintsonthereviewoffaircompetitionwillbestrengthened,andissuanceofpolicydocumentsthatexcludeandrestrictfaircompetitionwillbeavoided.(十三)公平参与标准制修订。支持外商投资企业 以相同条件参加先进制造、工程材料、信息通信等标准化 技术委员会或相关标准化组织机构,依法平等参与标准制 定修订工作。及时公开国家标准信息,提高标准化工作的 透明度、开放性。13. Fairparticipationinthedevelopmentandrevisionofstandards.Foreign-fundedenterpriseswillbesupportedinparticipatinginthestandardizationtechnicalcommitteesofadvancedmanufacturing,engineeringmaterials,informationandcommunicationsorrelevantstandardizationorganizationsunderthesameconditions,andparticipatinginthedevelopmentandrevisionofstandardsonanequalfootinginaccordancewiththelaw.Theinformationonnationalstandardswillbedisclosedinatimelymannertoimprovethetransparencyandopennessofthestandardizationwork.14. Improvingthescientificlevelofadministrativelawenforcement.Theadministrativelawenforcementpublicitysystemwillbestrictlyimplemented,andthelistofadministrativeinspectionitemswillbestrictlyimplemented.Repeatedinspectionswillberesolutelyavoided,irregularadministrativelawenforcementbehaviorswillbecorrectedinatimelymanner,andoff-sitesupervisionwithremotesupervision,earlywarning,preventionandcontrolasthemaincharacteristicswillbegraduallyimplemented.15. Strengtheningservicesforforeign-fundedenterprises.Platformssuchastheroundtableconferenceofforeign-fundedenterpriseswillbeeffectivelyutilized,todeepenregularexchangeswithforeign-fundedenterprises,associationsofforeignchambersofcommerce,andinternationalorganizations,respondtotheconcernsofallpartiesinatimely(十四)提高行政执法科学化水平。严格落实行政执法公示制度,严格执行行政检查事项清单,坚决避免重复检查,及时纠正不规范的行政执法行为,逐步推行以远程监管、预警防控为主要特征的非现场监管。(十五)持续打造“投资中国”品牌。依托重要展会平台,开展“投资中国”重点投资促进活动,向境外投资者全方位展现我国优质营商环境和投资机遇。建立健全工作机制,发挥驻外使领馆经商机构作用,支持地方“走出去”、“请进来”相结合,常态化开展招商引资工作。组织国际产业投资合作对接活动,促进更多项目洽谈签约。(十六)加强外商投资企业服务。用好外资企业圆桌会议等平台,深化与外商投资企业、外国商会协会、国际组织的常态化交流,及时回应各方关切,针对性做好服务保障。完善各级外商投资企业投诉跨部门协调工作机制,健全外商投资企业直接联系制度,畅通沟通渠道,及时了解并推动解决外商投资企业反映的问题和合理诉求。落实外商投资信息报告制度,持续推进部门数据共享,通 过部门信息共享能够获得的信息,不得要求外商投资企业 重复报送。四、畅通创新要素流动,促进内外资企业创新合作(十七)支持外商投资企业与总部数据流动。规范 数据跨境安全管理,组织开展数据出境安全评估、规范个 人信息出境标准合同备案等相关工作,促进外商投资企业 研发、生产、销售等数据跨境安全有序流动。制定粤港澳 大湾区跨境数据转移标准,依托横琴粤澳深度合作区、前 海深港现代服务业合作区等重大合作平台,建立港澳企业 数据跨境流动机制,探索建立跨境数据流动“白名单”制 度,稳步推动实现粤港澳大湾区内数据便捷流动。manner,andeffectivelyprovidetargetedservices.Theinterdepartmentalcoordinationmechanismsofalllevelsforcomplaintsfromforeign-fundedenterpriseswillbeimproved,thedirectcontactsystemforforeign-fundedenterpriseswillbeimproved,andthecommunicationchannelswillbesmoothed,soastounderstandandpromotetheresolutionoftheproblemsandreasonabledemandsofforeign-fundedenterprisesinatimelymanner.Theforeigninvestmentinformationreportingsystemwillbeimplemented,andinter-departmentaldatasharingwillbecontinuouslypromoted.Foreign-fundedenterprisesisnotberequiredtorepeatedlysubmittheinformationthatcanbeobtainedthroughinter-departmentalinformationsharing.IV.Smoothingtheflowofinnovationfactorsandpromotinginnovativecooperationbetweendomesticandforeign-fundedenterprises17. Supportingdataflowbetweenforeign-fundedenterprisesandtheirheadquarters.Thecross-borderdatasecuritymanagementwillbestandardized,anddataexitsecurityassessment,standardizedrecordationofpersonalinformationexitstandardcontractsandotherrelatedworkwillbeorganizedandcarriedout,topromotethecross-bordersafeandorderlyflowofresearchanddevelopment,production,salesandotherdataofforeign-fundedenterprises.Thestandardsforcross-borderdatatransferintheGuangdong-HongKo
