RegistrationforExaminationApersonwhomeetsthefollowingconditionsmayregistertolaketheGBAlegalprofessionalexamination:(1) HeorsheisaChinesecitizenwhoisapermanentresidentoftheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegion.(2) HeorsheupholdstheConstitutionofthePeople'sRepublicofChina,theBasicLawoftheHongKongSpecialAdministrativeRegionofthePeople,sRepublicofChina,and取得内地执业资质和从事律师职业试点工作期限的决定，继续在广东省广州市、深圳市、珠海市、佛山市、惠州市、东莞市、中山市、江门市、肇庆市开展试点工作，符合条件的香港法律执业者和澳门执业律师通过粤港澳大湾区律师执业考试，取得内地执业资质的，可以从事一定范围内的内地法律事务。现就做好试点工作制定本办法。一、报名符合以下条件的人员，可以报名参加粤港澳大湾区律师执业考试：（一）香港特别行政区、澳门特别行政区永久性居民中的中国公民；（二）拥护中华人民共和国宪法,拥护中华人民共和国香港特别行政区基本法、中华人民共和国澳门特别行政区基本法；theBasicLawoftheMacaoSpecialAdministrativeRegionofthePeople'sRepublicofChina.(3) HeorsheisalawyerorbarristerwhoisadmittedbytheHighCourtoftheHongKongSpecialAdministrativeRegioninaccordancewiththerelevantlawsoftheHongKongSpecialAdministrativeRegionandregisteredontheRegisterofLawyersortheRegisterofBarristers,andwhoselawyerrslicensehasnotbeensuspended,orapracticinglawyereffectivelydeterminedandregisteredattheAssociaaodosAdvogadosdeMacau.(4) Heorshehastheaccumulativeexperienceofpracticingasalawyerforthreeyearsormore.(5) Heorshehasgoodprofessionalethicsandhasnorecordofbeingpunishedforbadreputationorviolationofprofessionalethics.(6) HeorsheisabletowritelegaldocumentsinChineseandconductbusinessactivitiesinMandarin.II. ExaminationApersonwhoregisterstotaketheGBAlegalprofessionalexaminationshallparticipateintherelevantlegalknowledgetrainingorganizedbytheMinistryofJusticeandmaytaketheexaminationonlyafterheorshehasreceivedtherequiredtraining.（三）依据香港特别行政区有关法律，经香港特别行政区高等法院认许，在律师、大律师登记册上登记，且未被暂时吊销执业资格的律师、大律师，或者在澳门律师公会有效确定注册的执业律师；（四）具有累计三年以上律师执业经历；（五）职业道德良好，未有因不良名誉或者违反职业道德受惩处的记录：（六）能用中文书写法律文书，能用普通话进行业务活动。二、考试报名参加粤港澳大湾区律师执业考试的人员应当参加由司法部组织的有关法律知识培训，经培训后方可参加考试。Thespecificexaminationtime,testsubjects,andrelatedarrangementsshallbeannouncedbytheMinistryofJusticebeforethecorrespondingexamination.ThosewhohavepassedtheexaminationshallbenotifiedbytheMinistryofJustice.III. ApplicationforPracticeApersonwhohaspassedtheexaminationmayapplytotheDepartmentofJusticeofGuangdongProvinceforpracticeasalawyerintheGBAafterheorshehasreceivedthecentralizedtrainingorganizedbytheGuangdongLawyersAssociationandpassedtheassessment,andtheDepartmentofJusticeofGuangdongProvinceshallissueaLawyer'sLicense(GBA)tosuchperson.IV. BusinessScopeApersonwhohasobtainedaLawyer'sLicense(GBA)mayhandlecertaincivilandcommerciallegalbusinessaffairs(includinglitigationandnon-litigationsen,ices)towhichthemainland'slawsapplyinninemainlandcitiesoftheGuangdong-HongKong-MacaoGreaterBayArea(hereinafterreferredtoasthe"ninemainlandcitiesoftheGBA,.Thescopeoflitigationcaseswhicharecivilandcommercialcasesacceptedbyhigh,intermediate,andprimarypeople'scourtsandrelevantspecialpeople'scourtsinninemainlandcitiesoftheGBAshallbegoverned,mutatismutandis,bythescopeofcivilcasesinwhichHongKongandMacaoresidentswhohaveobtainedthenationaluniformlegalprofessionalqualificationandobtainedaLawyer'sLicenseinthemainlandmayserveas具体考试时间、考查科目和相关安排由司法部在考试前公布。通过考试的人员，由司法部发出考试合格的通知。三、申请执业考试合格的人员，经广东省律师协会集中培训并考核合格后，可以向广东省司法厅申请粤港澳大湾区律师执业，由广东省司法厅颁发律师执业证书（粤港澳大湾区）。四、业务范围取得律师执业证书（粤港澳大湾区）的人员，可以在粤港澳大湾区内地九市（以下简称大湾区内地九市）内，办理适用内地法律的部分民商事法律事务（含诉讼业务和非诉讼业务）。其中，诉讼案件为位于大湾区内地九市的高级、中级、基层人民法院和有关专门人民法院受理的民商事案件，案件范围参照取得国家统一法律职业资格并获得内地律师执业证书的港澳居民可以在内地人民法院代理的民事案件范围执行；非诉讼业务应当满足以下条件之：representativesinmainlandpeople'scourts;andnon-litigationservicesshallmeetanyofthefollowingconditions:(1) Iftheclientisanaturalperson,theplaceofhisorherregisteredpermanentresidenceorhabitualresidenceiswithintheninemainlandcitiesoftheGBA.(2) Iftheclientisalegalpersonoranyotherorganization,itsdomicileorregistrationplaceiswithintheninemainlandcitiesoftheGBA.(3) ThesubjectmatteriswithintheninemainlandcitiesoftheGBA.(4) ThecontractperformanceplaceiswithintheninemainlandcitiesoftheGBA.(5) Thelegalfactsthatleadtotheestablishment,modification,orterminationofcivilandcommercialrelationsoccurwithintheninemainlandcitiesoftheGBA.(6) ItisacommercialarbitrationcaseacceptedbyanarbitrationcommissionwithintheninemainlandcitiesoftheGBA.ApersonwhoholdsaLawyer'sLicense(GBA)shallenjoythesamerightsandperformthesameobligationsasamainlandlawyerwhenhandlingtheaforesaidlegalaffairs.（一）当事人为自然人的，户籍地或者经常居所地在大湾区内地九市内；（二）当事人为法人或者其他组织的，住所地或者登记地在大湾区内地九市内；（三）标的物在大湾区内地九市内；（四）合同履行地在大湾区内地九市内；（五）产生、变更或者消灭民商事关系的法律事实发生在大湾区内地九市内；（六）大湾区内地九市内仲裁委员会受理的商事仲裁案件。V. Practice Management五、执业管理持有律师执业证书（粤港澳大湾区）人员办理上述法律事务，与内地律师享有相同的权利，履行相同的义务。ApersonwhohasobtainedaLawyer'sLicense(GBA)maybeemployedbyamainlandlawfirmintheninemainlandcitiesoftheGBAorapartnershipassociationofaHongKongorMacaolawfinandamainlandlawfirmintheninemainlandcitiesoftheGBA,andshallnotbeemployedbyaforeignlawfirm'srepresentativeofficeinChinaortherepresentativeofficeofaHongKongorMacaolawfirminthemainland.ApersonwhohasobtainedaLawyer'sLicense(GBA)maybecomeapartnerofamainlandlawfirmintheninemainlandcitiesoftheGBA.ApersonwhohasobtainedaLawyer'sLicense(GBA)shallbesubjecttothesupervisionandadministrationoftheDepartmentofJusticeofGuangdongProvinceandthelocaljusticeadministrativeorganinaccordancewiththeLawyersLawofthePeople'sRepublicofChinaJointhelocallawyersassociation,participateintheannualassessment,beamemberoftheAllChinaLawyersAssociation,andbesubjecttotheindustryadministrationofthelawyersassociation.WhereapersonwhohasobtainedaLawyer'sLicense(GBA)failstocontinuouslysatisfytheeligibilityrequirementsforregistrationfortheexaminationorapplicationforpracticeasalawyer,theDepartmentofJusticeofGuangdongProvinceshallrevokehisorherLawyer'sLicense(GBA);andwhoevercommitsanyviolationoflawordisciplineshallhesubjecttoadministrativepunishmentorindustrydisciplinaryactionbytherelevantjusticeadministrativeorganorlawyersassociationinaccordancewiththeapplicablelawsandregulations.取得律师执业证书（粤港澳大湾区）的人员，可以受聘于大湾区内地九市的内地律师事务所或者大湾区内地九市的香港、澳门与内地合伙联营律师事务所，不得受聘于外国律师事务所驻华代表机构或者香港、澳门律师事务所驻内地代表机构。取得律师执业证书（粤港澳大湾区）的人员，可以成为大湾区内地九市的内地律师事务所合伙人。取得律师执业证书（粤港澳大湾区）的人员，依照中华人民共和国律师法接受广东省司法厅及所在地司法行政机关的监督管理，加入所在地的地方律师协会，参加年度考核，同时是中华全国律师协会会员，接受律师协会的行业管理。VI. Organization of Implementation六、组织实施取得律师执业证书（粤港澳大湾区）的人员，不能保持报名条件或者申请律师执业条件的，由广东省司法厅注销其律师执业证书（粤港澳大湾区）；有违法违纪行为的，由有关司法行政机关、律师协会依法依规给予行政处罚、行业处分。TheMinistryofJusticeshallberesponsiblefororganizingtheGBAlegalprofessionalexaminationandshalleffectivelyconductworksuchaspreparingexaminationquestionsandmarkingexaminationpapers,strengthenthesupervisionoftheexaminationwork,ensurethefairness,impartiality,andstrictorganizationoftheexamination;andguidetheDepartmentofJusticeofGuangdongProvincetoconscientiouslyandeffectivelyorganizetheimplementationofspecificwork,suchasregistrationfortheexamination,reviewofIheireligibilityforregistrationfortheexamination,training,andexaminationaffairs.TrainingandexaminationvenuesshallbelocatedinShenzhen,GuangdongProvince,andexaminationvenuesmayalsobesetupinZhuhai,GuangdongProvinceatthesametimeaccordingtothenumberofexaminationapplicantsinMacao.Thesourceofexaminationfundsshallcomefromfiscalfundsandexaminationfees.Examinationfeeitemsandfeeratesshallbegovernedbytherelevantprovisions.TheextensionperiodofthepilotprogramisfromOctober5,司法部负责组织实施粤港澳大湾区律师执业考试，做好命题、评卷等工作，加强对考试工作的监督，确保考试公平公正和组织严密；指导广东省司法厅认真做好组织实施报名、报名资格初审、培训、考务等具体工作。培训地点和考场设在广东省深圳市，视澳门报名人员规模，也可以同时在广东省珠海市设立考场。考试经费来源为财政经费和考试收费。考试收费项目和标准，按照有关规定执行。延长试点期限为2023年10月5日至2026年10月4日。2023toOctober4,2026.
