    NoticebytheGeneralOfficeoftheStateCouncilofMattersConcerningComprehensiveAdministrativeLawEnforcementinMarketRegulationDocumentNumber:LetterNo.942022oftheGeneralOfficeoftheStaleCouncilAreaofLaw:MarketManagement1.evelofAuthority:RegulatoryDocumentsoftheStateCouncilIssuingAuthority:GeneralOfficeoftheStateCouncilDateIssued:09-09-2022EffectiveDate:09-09-2022Status:EffectiveNoticebytheGenera!OfficeoftheStateCouncilofMattersConcerningComprehensiveAdministrativeLawEnforcementinMarketRegulation(LetterNo.942022oftheGeneralOfficeoftheStateCouncil)Thepeople'sgovernmentsofallprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment;allministriesandcommissionsoftheStateCouncilandallinstitutionsdirectlyundertheStateCouncil:TheGuidingCatalogueibrAdministrativeLawEnlbrcementItemsinMarketRegulation(hereinafterreferredtoasthe44GuidingCatalogue)isanimportantdocumentfortheuniformlyimplementinglawenforcementrequirementsinmarketregulationandspecifyingthefunctionsofcomprehensiveadministrativeenforcementinmarketregulation,andthe2020GuidingCataloguehasbeenapprovedbytheStateCouncilinprinciple.Withtheapprovalofthe国务院办公厅关于市场监督管理综合行政执法有关事项的通知(国办函(2022)94号)各省、自治区、直辖市人民政府,国务院各部委、各直属机构:市场监督管理综合行政执法事项指导目录(以下简称指导目录)是落实统一实行市场监管执法要求、明确市场监管综合行政执法职能的重要文件,2022年版指导目录已经国务院原则同意。根据深化党和国家机构改革有关部署,经国务院批准,现就有关事项通知如卜丁StateCouncil,youareherebynotifiedoftherelevantmattersasfollowsaccordingtotherelevantarrangementsfordeepeningtheinstitutionalreformofthePartyandtheState:I. DuringtheimplementationoftheGuidingCatalogue,undertheguidanceofXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,inaccordancewiththedecisionsandarrangementsoftheCPCCentralCommitteeandtheStateCouncil,thereformofcomprehensiveadministrativeenforcementinmarketregulationshallbevigorouslyadvanced,thefunctionsofadministrativeenforcementandlawenforcementresourcesshallbecoordinatedandallocatedonanoverallbasis,theissueofoverlappinglawenforcementshallbeeffectivelyresolved,andastrict,impartialandorderlylawenforcementwithgoodmannersanddisciplineshallbesupported.II. TheGuidingCatalogueismainlydesignedtoscrutinizeandregulateadministrativepunishmentandadministrativeenforcementitemsinthefieldofmarketregulationasprescribedinlawsandadministrativeregulations,aswellasadministrativepunishmentitemsasprescribedindepartmentalrules,suchaswarningsandfines.Theseitemswillbedynamicallyupdatedaccordingtotherelevantprocedures.Thebasisforimplementingadministrativepunishmentandadministrativecompulsoryitemsarethelaws,regulations,andrulescurrentlyinforce,andarenotrelatedtosuchcontentsasaddingtheresponsibilitiesandobligationsoftheadministrativecounterparts.WhereadministrativeenforcementitemsintheGuidingCatalogueinvolvethedutiesandfunctionsofrelevantdepartments,therelevantdepartments一、指导目录实施要以习近平新时代中国特色社会主义思想为指导,按照党中央、国务院决策部署,扎实推进市场监管综合行政执法改革,统筹配置行政执法职能和执法资源,切实解决多头多层重复执法问题,严格规范公正文明执法。二、指导目录主要梳理规范市场监管领域依据法律、行政法规设定的行政处罚和行政强制事项,以及部门规章设定的警告、罚款的行政处罚事项,并将按程序进行动态调整。行政处罚和行政强制事项的实施依据均为现行有效的法律法规规章原文,不涉及增加行政相对人责任义务等内容。指导目录中的行政执法事项涉及相关部门职责的,由相关部门根据法律、行政法规、部门规章的规定依法实施。各省、自治区、直辖市可根据法律、行政法规、部门规章立改废释和地方立法等情况,对有关事项进行补充、细化和完善,建立动态调整和长效管理机制。有关事项和目录按程序审核确认后,要在政府门户网站等载体上以适当方式公开,接受社会监督。shallimplementsuchitemsinaccordancewiththeprovisionsoflaws,administrativeregulations,anddepartmentalrules.Allprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentmayadd,refineandimprovetherelevantitems,andestablishadynamicadjustmentandlong-termmanagementmechanismbasedontheenactment,revision,repeal,andinterpretationoflaws,administrativeregulations,anddepartmentalrules,locallegislationandothercircumstances.Uponexaminationandconfinnationasrequired,therelevantitemsandthecatalogueshallbeproperlypublishedonthegovernments'portalwebsitesorbyothermeans,andbesubjecttopublicscrutiny.三、切实加强对市场监管领域行政处罚和行政强制事 项的源头治理,稳定市场预期,激发市场主体活力。凡没 有法律法规规章依据的行政执法事项一律取消。需要保留 或新增的行政执法事项,要依法逐条逐项进行合法性、合 理性和必要性审查。虽有法定依据但长期未发生且无实施 必要的、交叉重复的行政执法事项,要大力清理,及时提 出取消或调整的意见建议。需修改法律法规规章的,要按 程序先修法再调整指导目录,先立后破,有序推进。III. Themanagementofadministrativepunishmentandadministrativeenforcementitemsinmarketregulationshallbepracticallystrengthenedatthesource.Marketexpectationsshallbestabilized,andmarketplayersshallbeinvigorated.Alllawenforcementitemswithoutthebasisofanylaw,regulation,orruleshallbeabolished.Lawenforcementitemsthatneedtoberetainedorarenewlyaddedshallundergotheexaminationsoflegality,rationality,andnecessityonanitem-by-itembasis.Lawenforcementitemsthathavealegalbasisyethavenotbeenappliedforalongtimeandwithnoneedforimplementation,orthatareoverlappedinthecontentshallbelargelyremoved,andopinionsandrecommendationsonabolishingoradjustingtheseitemsshallbemadepromptly.Ifanylaw,regulation,orruleneedstoberevised,revisionsshallbemadeunderproceduresbeforetheGuidingCatalogueisupdatedsoastoensuretheorderlyadvancementoflawenforcementitems.IV. AdministrativeenforcementitemsincludedintheGuidingCatalogueshallbedividedbyitemsandmanagementsystemsaccordingtotherequirementsofreducingthelevelsoflawenforcementandpromotingthedevolutionofenforcementpower.Thefirstresponsibleentitiesshallbespecifiedaccordingtotheactualconditions,andtheresponsibilityforinvestigatingandpunishingillegalactivitiesshallbestrictlyfulfilled.Obligationsandpowersshallcomesidebysidetomakesurethatthoseempoweredshallshouldertheirresponsibilities;andresponsibilitiescomingwithadministrativeenforcementpowersshallbeascertainedonebyonesoastospecifytheresponsibleentities,basis,andcausesofaccountabilityandestablishmentofexemption,andtheaccountabilitymechanismshallbeimproved.Itisstrictlyprohibitedtopassontheresponsibilityoflawenforcementtoaprimary-levelauthorityinthenameofterritorialjurisdiction.Anyentityorindividualthatfailstoperformitsdutiesandfunctionsasrequiredshallbeheldaccountableaccordingtothedisciplineorthelaw.V. Theproceduresandprovisionsoncomprehensiveadministrativeenforcementinmarketregulationshallbedevelopedundertheprincipleofopenness,transparency,andefficiencyandaccordingtotherequirementsforperformingduties.Theworkprocedures,performanceofduties,timelimits,andcodeofconductforlawenforcementitemsshallbespecified,vaguenessandobscurityinadministrativeenforcementshallberemoved,anddiscretionarypowershallberestrictedandreduced.Theseeffortsaremadetoensurethatthesameitemunderthesamecircumstanceshallbepunishedandenforcedaccordingtothesamestandard.Administrative四、对列入指导目录的行政执法事项,要按照减少执法层级、推动执法力量下沉的要求,区分不同事项和不同管理体制,结合实际明晰第一责任主体,把查处违法行为的责任压实。坚持有权必有责、有责要担当、失责必追究,逐一厘清与行政执法权相对应的责任事项,明确责任主体、问责依据、追责情形和免责事由,健全问责机制。严禁以属地管理为名将执法责任转嫁给基层。对不按要求履职尽责的单位和个人,依纪依法追究责任。五、按照公开透明高效原则和履职需要,制定统一的市场监管综合行政执法程序规定,明确行政执法事项的工作程序、履职要求、办理时限、行为规范等,消除行政执法中的模糊条款,压减自由裁量权,促进同一事项相同情形同基准裁量、同标准处罚。将市场监管综合行政执法事项纳入地方综合行政执法指挥调度平台统一管理,积极推行“互联网+统一指挥+综合执法”,加强部门联动和协调配合,逐步实现行政执法行为、环节、结果等全过程网上留痕,强化对行政执法权运行的监督。六、按照突出重点、务求实效原则,聚焦市场监管领 域与市场主体、群众关系最密切的行政执法事项,着力解 决反映强烈的突出问题,让市场主体、群众切实感受到改 革成果。制定简明易懂的行政执法履职要求和相应的问责 办法,加强宣传,让市场主体、群众能够看得懂、用得 上,方便查询、使用和监督。结合市场监管形势任务和执 法特点,探索形成可量化的综合行政执法履职评估办法, 作为统筹使用和优化配置编制资源的重要依据。畅通投诉 受理、跟踪查询、结果反馈渠道,鼓励支持市场主体、群 众和社会组织、新闻媒体对行政执法进行监督。enforcementitemsinmarketregulationshallbeincludedinlocalcommandanddispatchplatformsforcomprehensiveadministrativeenforcementforunifiedmanagementsoastoadvancethepatternOf44Intemetplusunifiedcommandpluscomprehensiveenfbrcement.Jointactions,coordination,andcooperationbetweendepartmentsshallbestrengthened.Thecompleteprocessofadministrativeenforcement,includingactivities,steps,andoutcomes,shallbeabletobecheckedandaccessedontheInternet.Supervisionovertheoperationofadministrativeenforcementpowershallbeenhanced.VI. ThefocusshallbeputonadministrativeenforcementitemsinmarketregulationthatarecloselyassociatedwithmarketentitiesandthegeneralpublicaccordingtotheprincipleOfhighlightingkeyareasandpursuingefficiency.Effortsshallbemadetoresolveprominentproblemsofpublicconcernsandallowmarketentitiesandthepeopletoenjoytheachievementsofreform.Easy-to-understandrequirementsfortheperformanceofadministrativeenforcementandthecorrespondingmeasuresforaccountabilityshallbedeveloped;publicityshallbestrengthenedtoenablemarketentitiesandthepublictounderstandandapplythemandeasilyaccesstoandusethemandconductsupervision.Accordingtotheactualconditions,tasks,andcharacteristicsoflawenforcement,themeasuresforquantifiableassessmentoftheperformanceofadministrativeenforcementshallbeexploredandtakenasanimportantbasisforcomprehensiveuseandoptimizedallocationofresources.Effectivechannelsforacceptanceofcomplaints,trackingandinquiry,andresultfeedbackshallbeprovided.Marketentities,thepublic,socialorganizations,andthemediashallbeencouragedtooverseetheadministrative七、各地区、各部门要高度重视深化市场监管综合行 政执法改革,全面落实清权、减权、制权、晒权等改革要 求,统筹推进机构改革、职能转变和作风建设。要切实加 强组织领导,落实工作责任,明确时间节点和要求,做细 做实各项工作,确保改革举措落地生效。市场监管总局要 强化对地方市场监管部门的业务指导,推动完善执法程 序,严格执法责任,加强执法监督,不断提高市场监管综 合行政执法效能和依法行政水平。中央编办要会同司法部 加强统筹协调和指导把关。指导目录由市场监管总局根据本通知精神印发。国务院办公厅enforcementactivities.VII. Allregionsandalldepartmentsshallattachgreatimportancetodeepeningthereformofcomprehensiveadministrativeenforcementinmarketregulation,implementthereformrequirementsinacomprehensivemanner,suchasscrutinizing,delegating,restraining,andexposingadministrativepowers,andcoordinateeffortstopromoteinstitutionalreform,functionaltransformationandprofessionalethics.Effortsshallbemadetostrengthenorganizationalleadership,fulfillworkresponsibilities,specifyschedulesandrequirements,completevarioustaskscarefullyandeffectively,andensurethatallreformmeasureswillbeproperlyimplemented.TheStateAdministrationforMarketRegulationshallprovidestrongerguidancetolocalmarketregulatorydepartments,supporttheminimprovinglawenforcementproceduresandfulfillinglawenforcementresponsibilities,intensifysupervisioninlawenforcement,andcontinuouslyenhancetheefficiencyofcomprehensiveadministrativeenforcementinmarketregulationandthelevelofadministrationaccordingtothelaw.TheStateCommissionOfficeforPublicSectorReformshallworkwiththeMinistryofJusticetostrengthenoverallcoordinationandguidanceinthisregard.TheGuidingCatalogueshallbeissuedbytheStateAdministrationforMarkelRegulationundertheprincipleoftheNotice.GeneralOfficeoftheStateCouncil2022年9月9日September9,2022
